(c)(5) Notwithstanding any provision of this subtitle, the
Department shall have the authority to determine the location of
any sewerage system

CHARGE POINT included in the county plan required by this section.

Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the
immediate pres-
ervation of the public health and safety and having been pa
ssed by a
yea and nay vote supported by three fifths of all the members elected
to each of the two houses of the General Assembly, the
same shall
take effect from the date of its passage

JULY 1, 1970.

CHAPTER 255
(House Bill 198)

AN ACT to add new Section 9(70) to REPEAL AND RE-ENACT,
WITH AMENDMENTS, SECTION 9(54) OF Article 81 of the
Annotated Code of Maryland (1969 Replacement Volume), title
"Revenue and Taxes," subtitle "What Shall Be Taxed and Where,"
to follow immediately after Section 9(69) thereof, creating a
CREATING A STATEWIDE tax exemption under certain con-
ditions for the THE Nature Conservancy.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 9(70) be and it is hereby added to SECTION 9(54)
OF Article 81 of the Annotated Code of Maryland (1969 Replacement
Volume), title "Revenue and Taxes," subtitle "What Shall Be Taxed
and Where," to follow immediately after Section 9(69) thereof, and
BE AND IT IS HEREBY REPEALED AND RE-ENACTED WITH
AMENDMENTS to read as follows:

9.

(70) For purposes of county and local taxation only, property
real and personal, owned by the Nature Conservancy, or any chapter
thereof, if the property is used to aid in the
preservation of all types
of wild nature, to establish nature reserves or other protected areas,
or generally to promote conservation.

(54) REAL PROPERTY OWNED BY THE NATURE CON-
SERVANCY, OR ANY CHAPTER THEREOF, IF THE PROP-
ERTY IS USED TO ASSIST IN THE PRESERVATION OF WILD
NATURE AREAS, TO ESTABLISH NATURE RESERVES OR
OTHER PROTECTED AREAS, OR GENERALLY TO PROMOTE
CONSERVATION, PROVIDED SUCH PROPERTY IS ULTI-
MATELY INTENDED FOR FUTURE PUBLIC OWNERSHIP.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
