Sec. 3. And be it further enacted, That all laws or parts of laws,
public general or public local, inconsistent with the provisions of
this Act are hereby repealed to the extent of any such inconsistency.
Sec. 4. And be it further enacted, That this Act shall take effect
July 1, 1970.

AN ACT to add a new Section 394B to Article 43 of the Annotated
Code of Maryland (1957 Edition, 1965 Replacement Volume, 1969
Supplement), title "Health," subtitle "Water, Ice and Sewerage,"
to follow immediately after Section 394A thereof and to be under
the same title and subtitle; to require the closing and covering of
landfill refuse disposal systems in a manner which prevents
erosion, health and safety hazards, nuisances and pollution, and
the posting of a bond by private operators of landfill refuse dis-
posal systems to assure that such systems will be closed and
covered in the required manner; and relating generally to the
terms of the bond, the security therefor, and the nature and dura-
tion of liability thereunder.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 394B be and it is hereby added to Article 43
of the Annotated Code of Maryland (1957 Edition, 1965 Replace-
ment Volume, 1969 Supplement), title "Health," subtitle "Water,
Ice and Sewerage," to follow immediately after Section 394A thereof
and to be under the same title and subtitle, ALL to read as follows:
394B.
The holder or holders of any permit for a landfill refuse dis-
posal system issued under Section 394 of this Article , UPON THE
TERMINATION OF LANDFILL OPERATIONS, shall close and
cover all of the land for which the permit was issued in a manner
which prevents erosion, health and safety hazards, nuisances, and
pollution. This obligation shall be binding on the heirs, repre-
sentatives, successors and assigns of such holder or holders. Be-
fore a permit for a landfill refuse disposal system shall be issued
to any non-municipal corporation or to any other private organiza-
tion or person, the applicant for such permit shall file with the
State Department of Health a bond on a form to be prescribed and
furnished by the Department. The bond shall be payable to the
governing body of the political subdivision in which the landfill
is to be located, and the obligation of the bond shall be conditioned
upon the closing and covering of the landfill in a manner which
prevents erosion, health and safety hazards, nuisances, and pollu-
tion. The bond shall be in the amount of one thousand dollars
($1,000.00) for each acre of land for which the permit is to be
applied, but in no event less than twenty-five thousand dollars
($25,000). Liability under the bond shall be for the duration of the
actual operation of the landfill and for a period of five years there-
