visions or any other application of this Act which can be given effect
without the invalid provisions or application, and to this end all the
provisions of this Act are declared to be severable.

Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1970.

AN ACT to repeal Sections 698 and 703 of Article 43 of the An-
notated Code of Maryland (1957 Edition, 1965 Replacement Vol-
ume and 1969 Supplement), title "Health," subtitle "Air Quality
Control," and to enact new Sections 698 and 703 in lieu thereof, to
stand in the place of the sections so repealed, and to add new
Sections 705 and 706 to such Article to repeal laws relating to
the enforcement of air quality control laws and regulations and
to provide new and additional procedures for the enforcement of
air quality control laws and regulations, to provide for injunctive
relief and assessment of civil penalties against persons violating
air quality control laws and regulations, to authorize municipal
and county air pollution ordinances and regulations, and to au-
thorize the Secretary to require permits for the operation of
equipment contributing to air pollution.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 698 and 703 of Article 43 of the Annotated Code
of Maryland (1957 Edition, 1965 Replacement Volume and 1969
Supplement) title, "Health," subtitle "Air Quality Control," be and
they are hereby repealed, and new Sections 698 and 703 be and
they are hereby enacted in lieu thereof, to stand in the place of
the sections so repealed, and new Sections 705 and 706 be and are
hereby added to Article 43, all to be under the subtitle "Air Quality
Control," and to read as follows:

698. Notice of Violation, Corrective Orders and Hearings.

(a) Notice of Violation and Corrective Orders.—Whenever the
Department shall determine that compliance with the provisions of
this subtitle or any standard, rule or regulation promulgated by
the Secretary has not been obtained from any person, the Depart-
ment may:

(1)  give written notice to such person specifying the provisions
of this subtitle or the rule or regulation said to be violated and the
manner of AND extent in and to which such person is said to violate
same and requiring such person to appear and show cause why an
order should not be issued requiring corrective action to be taken
within a period of time to be determined at such hearing; or,

(2)  give written notice to such person specifying the provision
of this subtitle or the rule or regulation said to be violated and
