for the submission by the Superintendent of Schools for Mont-
gomery County to the County Executive of Montgomery County
for his review and submission to the County Council of six year
capital improvement programs, and for adoption of such programs
by the County Council after public hearings.
Section 1. Be it enacted by the General Assembly of Maryland,
That there is hereby added a new Section 120A to Article 77 of the
Annotated Code of Maryland (1969 Replacement Volume), title
"Public Education," subtitle "Finance and Reports" and to read as
follows:
120A. Six-year Programs in Montgomery County.
(a) Prior to December 15th of each calendar year, the Super-
intendent of Schools for Montgomery County shall prepare and sub-
mit to the County Executive for Montgomery County a six-year cap-
ital improvements program. The capital improvements program
shall include a statement of the objectives of the capital programs
and relationship of these programs to the county's adopted long
range development plans; shall recommend capital projects and a
proposed construction schedule; and shall provide an estimate of cost
and a statement of all funding sources. The capital improvements
program shall include all anticipated capital projects and programs
of the Board of Education, including substantial improvements and
extensions of projects previously authorized. The County Executive
shall include the Superintendent's six-year program, with his recom-
mended revisions and modifications, in the comprehensive six-year
program submitted to the Montgomery County Council pursuant to
Section 302 of the Charter for Montgomery County.
The county council shall, on or before adoption of its annual budget
and appropriations resolution, adopt a six-year capital improvements
program for the Board of Education as a part of the comprehensive
six-year program. Such adoption shall occur only after public hear-
ings on the county's and other agencies' six-year programs or capital
budgets. In its adoption, the council may make such amendments,
revisions, or modifications as it may determine. Any such amend-
ment, revision or modification shall not become final until submission
to the Board of Education for written comment on at least thirty
days' notice.
(b) Nothing herein shall be construed as superseding or impair-
ing the provisions of Section 117 of this Article 77, but shall be in
addition or supplementary thereto.
Sec. 2. Be it further enacted by the General Assembly of Maryland,
