recommendations of qualified persons to fill such vacancy or vacan-
cies and shall allow said Bar Association thirty (30) days in which
to submit said recommendations before making any appointment;
the County [Council] Executive shall not be bound by said recom-
mendations, but shall make no appointment under this section until
such recommendations, if received shall have been given due con-
sideration.

Sec. 2. And be it further enacted, That this Act shall take effect
on December 7, 1970.

CHAPTER 166
(House Bill 832)

AN ACT to repeal and re-enact with amendments Section 187D of
Article 66½ of the Annotated Code of Maryland (1969 Supple-
ment) title "Motor Vehicles," subtitle "Operation of Vehicles Upon
Highways," to authorize the County Council of Montgomery
County to delegate to the County Executive the power to regulate
the speed of vehicles on county roads and to provide for the pay-
ment of fines for speeding violations.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 187D of Article 66½ of the Annotated Code of Mary-
land (1969 Supplement) title "Motor Vehicles," subtitle "Operation
of Vehicles upon Highways," be and is hereby repealed and re-
enacted with amendments to read as follows:

187D.

Notwithstanding any other provisions of this Article, the County
Council and County Executive for Montgomery County and the
County Council and County Executive for Baltimore County are
authorized and empowered to regulate the speed of vehicles on any
road, street, lane or alley within these counties and outside the
corporate limits of any incorporated city, town or village and not
designated or maintained as a part of the state or federal highway
system or an extension thereof. The County Council and County
Executive
for Montgomery County and the County Council and
County Executive for Baltimore County also are authorized and
empowered to provide for the payment of fines for a conviction for
violating any such regulation made by it concerning the speed of
vehicles; any and all fines collected pursuant to the provisions of
this section shall be disposed of according to the procedure provided
in Section 341 of this Article. All traffic-control devices erected
under the authority of this section shall conform to the State manual
and specifications, as adopted under Section 189 of this Article.
Notwithstanding the provisions of this section, the County Executive
of Montgomery County shall only exercise such of those powers con-
ferred by this section as may be expressly delegated to him by a law
enacted by the County Council.
