An Act to establish, effectuate, and implement the purchasing
policies provided by Article VIII of the Howard County Charter;
to promote uniformity in purchasing; and to effect maximum savings
for all purchases out of County funds; TO PROVIDE FOR COM-
PETITIVE BIDDING; TO PROVIDE FOR DISPOSITION OF SUR-
PLUS, OBSOLETE, AND WASTE SUPPLIES; TO PROVIDE FOR
BIDDER'S LISTS AND IRRESPONSIBLE BIDDER'S LISTS; AND
TO PROVIDE PENALTIES FOR VIOLATION OF THIS ACT.
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
HOWARD COUNTY, MARYLAND, That Sections 4.100 through 4.118, in-
clusive, be and they are hereby added to Title 4 of the Howard County
Code, "Contracts and Purchasing," subtitle "Purchasing," to read as fol-
lows:
4.100—General
This Act shall be known and may be cited as the "Purchasing Act
of Howard County."
4.101—Purpose
The purpose of this Act is to implement and make effective the pur-
chasing policies provided by Article VIII of the Howard County Charter,
to promote uniformity in purchasing, and to effect maximum savings
for all purchases out of County funds. This Act shall be applicable
to all purchases and contracts for supplies, materials, equipment and
contractual services for any County department or agency, except as
otherwise provided by Public General or Public Local Law.
4.102—Definitions
For the purpose of this Act, the following terms, phrases, words,
and their derivations shall have the meanings given herein.
County or County Government—means the Government of Howard
County, Maryland.
Responsible Bid—means an offer, submitted by a responsible bidder
in ink or typewritten form, to furnish supplies, materials, equipment or
contractual services in conformity with the specifications, delivery terms
and conditions, and other requirements included in the invitation for
bids.
Responsible Bidder—means a bidder who submits a responsible bid:
who has furnished, when requested, information and data to prove that
his financial resources, service reputation and experience are adequate
to make satisfactory delivery of the supplies, materials, equipment or
contractual service on which he bids; and who has not violated, or attempted
to violate any provisions of this Act or of the Howard County Charter.
Irresponsible Bidder—means a bidder or prospective bidder who fails
to furnish, upon written request, proof of his responsibility; who has, as
a vendor or contractor with the County, repeatedly made slow or unsatis-
factory delivery; or who has violated, or attempted to violate the provisions
of this Act or the Howard County Charter.
Bidders List—means a current file of sources of supply or articles
for each category of commodities repetitively purchased for County use.
