Section 3. And be it further enacted by the County Council of Howard
County, Maryland,
That this Act is hereby declared to be an emergency
measure and necessary for the immediate preservation of the public health,
safety, and welfare and having been passed by the affirmative vote of
two-thirds of the members elected to the Council, the same shall take
effect from the date of its enactment.

This Bill, having been approved by the Executive and returned to
the Council, stands enacted on March 12, 1969.

Council Bill No. 3

An Act to repeal Sections 343, 344 and 347 of the Code of Public
Local Laws of Howard County (1965 Edition), being Article 14 of
the Code of Public Local Laws of Maryland, title "Zoning districts;
designation; procedure, hearings, notice," and to enact new Sections
16.200 through 16.209, inclusive, of the Howard County Code, to
provide for a legislative agency of the County Council consisting of
the members of the County Council to be the Zoning authority of
Howard County, to provide for the designation, establishment, adop-
tion, modification, supplementation, enforcement, and repeal of zoning
districts, boundaries, and regulations, to provide for the procedure
of designation, establishment, adoption, amendment, modification, sup-
plementation and repeal thereof, and to provide further for appeals
from decisions of the Zoning Board, and, further declaring this Act
to be an emergency measure.

Section 1. Be it enacted by the County Council of Howard County,
Maryland,
That Sections 343, 344 and 347 of the Code of Public Local Laws
of Howard County (1965 Edition), being Article 14 of the Code of Public
Local Laws of Maryland, be and they are hereby repealed.

Section 2. Be it further enacted by the County Council of Howard
County, Maryland,
That Sections 16.200, 16.201, 16.202, 16.203, 16.204,
16.205, 16.206, 16.207, 16.208, and 16.209 be and the same are hereby
added to Title 16 of the Howard County Code, "Planning, Zoning and
Sub-Division Control", subtitle "Zoning", to read as follows:

16.200—General

This Act provides that the Zoning Authority of Howard County shall
be the Howard County Zoning Board. This Act may be cited as the Zoning
Enabling Act of Howard County.

16.201—Policy

It is the intention of the County Council of Howard County in the
enactment of this subtitle to establish a legislative agency of the County
Council which shall be the zoning authority of Howard County. The zoning
authority so created shall be known as the Howard County Zoning Board
and shall consist of the members of the County Council. The Chairman of
the County Council shall be the chairman of the Zoning Board; the vice-
chairman of the County Council shall be the vice-chairman of the Zoning
Board. The duly appointed Secretary of the County Council shall be the
Secretary of the Zoning Board. The Zoning Board shall have such expenses
and such other employees as may, from time to time, be provided in the
budget.
