are hereby repealed and reenacted, with amendments, and a new Section
84-12A, title "Non-discrimination in Employment," is hereby added to read
as follows:

84-11. Definitions.

For the purposes of this article, the following terms, phrases, words
and their derivations shall have the following meanings:

Bid. An offer, submitted by a responsible bidder, in ink or type-
written, to furnish goods or services in conformity with the specifications,
delivery terms and conditions and other requirements included in the
invitation for bids.

Bidder's list. A current file of sources of supply for each category
of commodities repetitively purchased for county use.

Capital improvement project. Any contract for the physical public
betterment or improvement of county property, including buildings, roads
or other county facilities, when the labor is to be performed by other
than county forces.

Contractual services. All services of any nature whatsoever includ-
ing but not limited to any repair or maintenance of equipment, build-
ings, machinery, other county-owned or operated personal or real property,
and insurance on such property. The term "contractual services" shall not
include contracts for professional services.

County or county government. The government of Montgomery
County, Maryland.

Goods. Supplies, materials, equipment and all tangible commodities,
except real property.

Professional services. The services of attorneys, physicians, archi-
tects, engineers, consultants or other individuals or organizations whose
services by their nature are unique and are customarily negotiated.

Shall. The word shall is always mandatory, and not merely directory
as used herein.

Using agency. Any department, office, board or any other unit of the
county government using supplies or procuring contractual services as
provided for in this article. The county board of education is specifically
excepted.

84-12. Purpose of article.

The purpose of this article is to make effective the requirements of
Sections 313 and 314 of the Montgomery County Charter, which provides
for centralized purchasing and competitive bidding for purchases in excess
of three thousand dollars. This article shall be applicable to all purchases
and contracts for goods and services used by any county department or
agency which are to be paid for out of county funds, except as otherwise
provided by public general or public local law.

84-12A. Non-discrimination in Employment.

The chief administrative officer shall, subject to the direction of the
County Executive, insure that each and every county contractor adheres
to the following standard and each contract shall contain a requirement
