to the nearest police substation within forty-eight hours of the time
when such notice was so attached to such vehicle, exclusive of Sundays,
and to pay as a penalty and in full satisfaction of such violation the
sum of two dollars, or as shall otherwise be fixed from time to time
by the county executive with the approval of the County Council.
Section 12. Section 108-16, Chapter 108, title "Vehicles, Traffic and
Parking", of the Montgomery County Code 1965 is hereby repealed and
re-enacted, with amendments, to read as follows:
108-16. Duty of police—To report illegally parked vehicles; information
to be shown.
It shall be the duty of the police officers of the County, or any
other County employees specifically designated by the county executive
or his designee to police parking meters and to report:
(1) The number of each parking meter which indicates that the
vehicle occupying the parking zone adjacent to such parking meter, is
or has been parked in violation of any of the provisions of this article;
(2) The state license number of such vehicle, and;
(3) Any other facts, a knowledge of which is necessary to a thor-
ough understanding of the circumstances attending such violation.
Section 13. Section 115-10, Chapter 115, title "Parking Regulations",
of the Montgomery County Code 1965 is hereby repealed and re-enacted,
with amendments, to read as follows:
115-10. Applicability of Article.
The provisions of this Article shall be effective throughout the sub-
urban district, except in any incorporated town or special taxing area,
to the extent that such special taxing area has authority to adopt reg-
ulations equivalent to those herein contained. If the governing body
of such incorporated town or special taxing area lawfully adopts this
Article and requests the county executive to provide for the adminis-
tration and enforcement thereof within such town or special taxing area,
then the County government may administer and enforce this Article
within such town or special taxing area.
Section 14. Severability.
The provisions of this Act are severable and if any provision, sentence,
clause, section or part thereof, is held illegal, invalid or unconstitutional
or inapplicable to any person or circumstances, such illegality, invalidity
or unconstitutionally, or inapplicability shall not affect or impair any
of the remaining provisions, sentences, clauses, sections or parts of the
Act or their application to other persons or circumstances. It is hereby
declared to be the legislative intent that this Act would have been adopted
if such illegal, invalid or unconstitutional provision, sentence, clause, sec-
tion or part had not been included therein, and if the person or cir-
cumstances to which the Act or any part thereof is inapplicable had
been specifically exempted therefrom.
Section 15. Effective date.
This Act shall take effect on December 7, 1970.
