Chapter 13
(Bill No. 10-69)

An Act to repeal and reenact, with amendments, Section 2-83, title
"Fire Board," of Article XIII, title "Advisory Boards", Montgomery
County Code 1965, to establish a Montgomery County Fire Board to
be composed of the chief and one elected delegate from each of the
fire departments and rescue squads in the County; to provide for an
executive committee and a personnel committee for the fire board,
their membership and duties; to authorize certain responsibilities and
duties of the said fire board, to include the preparation of fire and
rescue service maps, investigation and planning for fire and rescue
station locations, establish minimum standards for entrance qualifica-
tions, uniform fiscal and budget procedures, recommend purchasing
procedures; to study and report on fire taxing areas financing; to
require bonding of department and squad treasurers; to provide for
auditing of accounts; and to provide for distribution of fire tax district
revenues.

Be It Enacted by the County Council for Montgomery County, Maryland,
that—

Section 1. Section 2-83, title "Fire Board", of Article XIII, title
"Advisory Boards", is hereby repealed and reenacted, with amendments,
to read as follows:

Sec. 2-83. Fire Board.

(a) Fire Board Established and Membership.

There is hereby established a Montgomery County Fire Board, to be
composed of the chief of each fire department and rescue squad within the
County, including the chief of the fire department of the City of Takoma
Park, Maryland and one elected delegate from each fire department and
each rescue squad, said delegate to be elected annually in June from among
the membership of the respective departments and squads. One delegate
shall be appointed by the Mayor and City Council of the City of Takoma
Park. Any vacancy occurring among delegates shall be filled within 30
days by the squad, department, or city in the manner of the original
election or appointment. Such delegate shall serve until the next annual
election. The chiefs and elected delegates will vote as individual repre-
sentatives of their respective departments and squads and shall not be
bound by their departments' or squads' decision in any vote which they
shall cast as members of the board. The board shall have a fulltime
executive assistant and, in addition, shall have such other staff employees
as may be provided for in its approved budget as necessary to carry out
the functions of the board. The board shall elect annually at its first
meeting after the June election from among its members a chairman and
such other officers as provided for in its bylaws. The selection of the
chairman shall be subject to approval by the county council and if not
approved, another election shall be held. The chairman shall serve until
his successor has been elected and approved.
