Section 5. AND BE IT FURTHER ENACTED, That any employee
of the County receiving a pension under any prior law shall continue to
receive such pension at the rate set by such prior law as though and to
the same extent as if such prior law had not been repealed by this ordinance
and such pension shall not be discontinued or diminished by any provisions
of this ordinance.
Section 6. AND BE IT FURTHER ENACTED, That this Ordinance
is hereby declared to be an emergency ordinance and necessary for the
immediate preservation of the public peace, health, safety, welfare and
property, and being passed by the affirmative vote of five members of the
County Council, the same shall take effect from the date it becomes law,
provided that not less than fifty percent (50%) of the present County
employees who are now in the State Pension Plan accept the County Plan
by June 30, 1969.
Section 6. AND BE IT FURTHER ENACTED, THAT THIS ORDI-
NANCE SHALL TAKE EFFECT FORTY-FIVE (45) DAYS FROM THE
DATE IT BECOMES LAW, PROVIDED THAT NOT LESS THAN FIFTY
PERCENT (50%) OF THE PRESENT COUNTY EMPLOYEES WHO
ARE NOW IN THE STATE PENSION PLAN ACCEPT THE COUNTY
PLAN BY JUNE 30, 1969.

AN EMERGENCY ORDINANCE to add new Section 17-401(b)
to the Anne Arundel County Code (1967 Edition and Supplements),
Title 17, "Taxation," Subtitle 4, "Erosion District Taxes," to follow
immediately after Section 17-401 (a) thereof, codifying the Tydings-
on-the-Bay taxing and assessment district as established by the
County Commissioners of Anne Arundel County and excepting there-
from certain parcels of ground within the Podickory Point subdivision.
Whereas, the County Commissioners of Anne Arundel County, Mary-
land did, on or about November 29, 1937, establish the Tydings-on-the-Bay
taxing and assessment district, which was subsequently defined by a plat
approved by the County Roads Engineer dated December 7, 1937 (and
which plat has since disappeared); and
