(b) The election of the Contingent Annuitant Option shall be made
on a form furnished by the Personnel Officer and shall be subject to
submission of evidence of the participant's good health satisfactory to the
County if made within two years of the participant's early retirement
date or normal retirement date, whichever first occurs. If an election of
an optional form of annuity is in effect when the participant becomes
entitled to receive an early retirement pension (in accordance with the
terms of Section 1-221 (b), such option will remain effective, provided
that evidence of the participant's good health satisfactory to the Personnel
Officer is submitted at that time.
Section 1-225.
An employee whose pension payments commence before his Social
Security payments begin may elect, by written application filed with the
Personnel Officer, to receive an actuarial equivalent benefit of larger pen-
sion payments under this ordinance until Social Security payments com-
mence, and smaller pension payments thereafter, thus providing insofar
as practicable a uniform total income from both sources.
Section 1-226.
(a) A participant's annual pension will be payable monthly with
each monthly payment equal to l/12th of the annual amount. The first
payment shall be payable on the date specified in Section 1-221 or Section
1-222 of this Article, and subsequent payments shall be paid on the first
day of each month thereafter, terminating with the last monthly payment
payable prior to the participant's death.
(b) Quarterly payments may be made in advance, each equal to
three monthly payments or, with the consent of the payee, a single sum
payment in an actuarially equivalent amount may be made, if the amount
of any monthly payment payable to any payee would be less than $10
but more than $4.99. A single sum payment in an actuarially equivalent
amount may be made in lieu of monthly payments if the amount of each
monthly payment would be less than $5.00.
(c) All payments, benefits, and refunds hereunder to a participant
or other payee are for the support and maintenance of such payee and
shall not be assigned, commuted or anticipated and shall be free from
the claims of all creditors to the fullest extent permitted by law.
(d) If in the judgment of the Personnel Officer any payee is legally,
physically or mentally incapable of personally receiving and receipting for
any payment due him, such payment or any part thereof may be paid to
any person or institution who, in the opinion of the Personnel Officer is
then maintaining or has custody of the payee until claim is made by
the duly appointed guardian or other legal representative of the payee.
(e) If a payee other than an elected or appointed official who is
receiving benefits (other than disability benefits) under this plan is em-
ployed or re-employed by the County in any capacity, such benefits shall
be reduced by One Dollar ($1.00) for each Two Dollars ($2.00) he receives
in basic compensation from the County.
Section 1-227.
If a participant's death occurs:
