[5] (4) Nothing contained herein shall be construed to permit the
county to waive the special water and special wastewater benefit charge
as set forth in section 17-608 or the area benefit charge as set forth
in section 17-610.
(d) Any person who shall be liable for, or who shall have paid,
an area service charge under the Sanitary Commission Act or a capital
connection charge shall be entitled to recover an amount equal to such
[area service] charge, after its payment, by one or more annual credits
against [the area benefit] the charge for which he shall be assessed
hereunder.
Section 2. AND BE IT FURTHER ENACTED, That this Ordinance
shall take effect forty-five (45) days from the date it becomes law.
SECTION 2. AND BE IT FURTHER ENACTED, THAT THIS OR-
DINANCE IS HEREBY DECLARED TO BE AN EMERGENCY ORDI-
NANCE AND NECESSARY FOR THE IMMEDIATE PRESERVATION
OF THE PUBLIC PEACE, HEALTH, SAFETY, WELFARE AND PROP-
ERTY AND BEING PASSED BY THE AFFIRMATIVE VOTE OF
FIVE MEMBERS OF THE COUNTY COUNCIL, THE SAME SHALL
TAKE EFFECT FROM THE DATE IT BECOMES LAW.

AN EMERGENCY ORDINANCE to add new Sections 1-218 through
1-238, inclusive, to the Anne Arundel County Code (1967 Edition and
Supplements), Title 1, "Administration", Subtitle 2, "Personnel",
to follow immediately after Section 1-217 thereof and to be under
a new Article III, "Employees' Retirement Plan", creating an em-
ployees' retirement plan for Anne Arundel County, providing for
eligibility, retirement benefits, disability, vesting and withdrawal
of benefits, death benefits, pension fund and contributions, the trans-
fer of certain County officers and employees to the Anne Arundel
County Retirement Plan, and matters generally related thereto.
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That new Sections 1-218
