solids. In no case shall any ice cream weigh less than four and one-
half pounds per gallon and contain less than one and six tenths
(1.6) pounds of total food solids per gallon.

(b)

(ii) Artificially sweetened ice cream means the pure, clean,
frozen products made from a combination of milk products, sorbitol,
a nonnutritive artificial sweetener for use only by persons who must
restrict their intake of ordinary sweets, with or without egg or egg
products, with harmless flavoring and with or without harmless
coloring, and with or without added stabilizer or emulsifier com-
posed of wholesome edible material. It shall contain not more than
one half of one per centum by weight of stabilizer and not more than
one fifth of one per centum by weight of emulsifier, not less than ten
per centum by weight of milk fat, and not less than twenty per
centum by weight of total milk solids; except when fruit, nuts,
cocoa, chocolate, maple syrup, cakes or confection are used for the
purpose of flavoring, said flavoring shall be sweetened only with an
artificial sweetener, then such reduction in milk fat and in total
milk solids as is due to the addition of such flavors shall be permitted,
but in no such case shall it contain less than eight per centum by
weight of milk fat, nor less than sixteen per centum by weight of
total milk solids. In no case shall any artificially sweetened ice
cream weigh less than four and one-half pounds per gallon and
contain less than one and six-tenths (1.6) pounds of total food solids
per gallon.

(iii) Subject to the standards provided by law or prescribed by
rules or regulations by the State Department of Health pursuant
thereto, any person may manufacture or prepare artificially sweet-
ened ice cream, containing an artificial sweetening agent approved
by the State Department of Health. The manufacturer shall place
the artificially sweetened ice cream only in pint packages or contain-
ers which shall be conspicuously labeled, "Artificially Sweetened"
immediately preceding the words "Ice Cream," in similar type at
least one half the size of the type used for the words "Ice Cream,"
and on the same contrasting background, and in addition shall label
thereon INTENDED FOR DIABETICS UNDER MEDICAL AD-
VICE and any other warning statement which the State Department
of Health may prescribe. The label shall also contain a statement in
terms of percentage by weight of protein, fat and carbohydrates,
the total number of calories per ounce, the number of calories con-
tributed by carbohydrates and any carbohydrates other than lactose,
and the name of each ingredient entering into the composition
other than flavors. The artificially sweetened ice cream shall not be
sold in any quantity or in any manner other than in a sealed or un-
broken pint package or container.

(iiii) "Mellorine" means the pure, clean mix and frozen products
made from a combination of food fat, nonfat milk solids, optional
sweetening ingredients as regulated by the State Department of
Health with or without egg or egg products, with harmless flavoring
and with or without harmless coloring, and with or without stabili-
zer or emulsifier as regulated by the State Department of Health.
It shall contain not more than one half of one per centum by weight
of stabilizer and not more than one fifth of one per centum by
weight of emulsifier and not less than ten percentum by weight of
