with the department providing for the establishment and protection
of the trail. The Appalachian Trail shall be held, developed, and
administered primarily as a footpath and the natural scenic beauty
thereof shall be preserved insofar as is practicable, but the depart-
ment may permit other uses of the trail and land acquired hereunder,
by the owner of adjoining land or others, in a manner and at seasons
as will not substantially interfere with the primary use of the trail.
Nothing in this section shall be construed to limit the right of the
public to pass over existing public roads which are part of the trail,
or to prevent the department from performing work necessary for
the purpose of forest fire prevention and control, insect pest and
disease control, and the removal of damage caused by natural dis-
aster. The department may grant temporary or permanent rights of
way across lands acquired under this section under terms and con-
ditions deemed advisable. The department may enter into coopera-
tive agreements with agencies of the federal government or with
private organizations to provide for the maintenance of the trail.
No person who has granted a right of way for the trail across his
land, or his successor in title, shall be liable to any user of the trail
for injuries suffered on this portion of the trail unless the same are
caused by his willful or wanton misconduct.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.

CHAPTER 542
(Senate Bill 88)

AN ACT to repeal and re-enact, with amendments, Section 181A of
Article 41 of the Annotated Code of Maryland (1965 Replacement
Volume), title "Governor—Executive and Administrative Depart-
ments," subtitle "Maryland Historical Trust," providing that the
words "property" and "properties" in the laws concerning the
Maryland Historical Trust include scenic, architectural, or facade
easements on buildings or structures and thereby granting certain
powers to the Maryland Historical Trust with respect to scenic,
architectural, or facade easements.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 181A of Article 41 of the Annotated Code of Maryland
(1965 Replacement Volume), title "Governor—Executive and Admin-
istrative Department DEPARTMENTS," subtitle "Maryland His-
torical Trust," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

181A.

The Maryland Historical Trust is hereby created for the purpose
of preserving and maintaining historical, aesthetic and cultural
properties, buildings, fixtures, furnishings, and appurtenances per-
taining in any way to the province and State of Maryland from
earliest times, to encourage others to do so and to promote interest
