ized by written order of the superintendent of the Department of
Maryland State Police.

§ 14-112. Fees, permits, and rules and regulations for excess size
and weight.

(a)    A fee is imposed on every oversize motor vehicle using the
highways of the State. The State Roads Commission may issue a
permit for oversize motor vehicles using the highways of the State,
and the permit shall specify the route to be followed, and the hour
and date on which passage is to be effected and maximum size. The
fee to be charged for the permit shall be $10.00, unless otherwise
provided in this section.

(b)    A charge is hereby imposed on the weight of all vehicles in
excess of that permitted by law and every vehicle having overweight
shall secure a permit from the State Roads Commission, the charge
for which shall be $10.00 for a gross weight not exceeding 45 tons.
If the gross weight is in excess of 45 tons, the charge for the permit
will be $10.00 for the first 45 tons and $1.00 for each additional ton
in excess of 45 tons.

(c)    In order to facilitate the obtaining of permits for the move-
ment of oversize and overweight vehicles on the highways and to
eliminate undue hardships to political subdivisions, contractors, and
the movers of heavy or large equipment over the highways and in
order to make possible the issuing of permits, when circumstances
justify, under which more than one move can be made, the State
Roads Commission, acting in conjunction with the Department of
Maryland State Police, may formulate rules and regulations imple-
menting the statutes relating to the movement of oversize and over-
weight vehicles on highways, provided, however, the regulations
shall not modify or enlarge the height, width, length, and weight
of vehicles now or hereafter authorized by law to use the highways
of the State. The Commission, with the concurrence of the Depart-
ment of Maryland State Police, may adopt reasonable penalties for
the violation of the rules and regulations. The minimum penalty for
each violation shall be a fine of $10.00 and the maximum penalty
for each violation shall be $100.00.

(d)    Before the rules and regulations become effective they shall
be advertised once a week for two weeks in two newspapers of
general circulation in the State and the advertisement, in addition
to setting forth the rules and regulations, shall set a time and place of
a public hearing thereon. After the hearing before the Commission,
or its duly designated representatives, the Commission shall adopt
the rules and regulations or modifications thereto as appropriate.
The Commission, with the concurrence with the State Police, may
change, modify, or amend the regulations but only after due notice
and a hearing thereon is held as above prescribed.

§ 14-113. When the State Roads Commission or local authorities
may restrict right to use highways.

(a) The Boards of County Commissioners or the County Council
of any county with the approval of the Chairman of the State Roads
Commission, or his duly authorized representative, with respect to
any road or highway under its jurisdiction or maintenance by resolu-
