CHAPTER 530
(Senate Bill 357)

AN ACT to repeal and re-enact, with amendments, Subsections
(a) (1) (vi) and (b) (2) (ii) of Section 61 of Article 66˝ of
the Annotated Code of Maryland (1957 Edition, 1967 Replacement
Volume, 1969 Supplement), title "Motor Vehicles," subtitle "Ad-
ministration—Registration—Titling"; and to add new Subsections
61 (a) (5) and 61 (d) (4) (xiv) to said Section 61, TO FOLLOW
IMMEDIATELY AFTER 61 (A) (4) AND 61 (D) (4) (XIII)
RESPECTIVELY, to add new Sections 50, 296B and 312A, to
Article 66˝ of the Annotated Code of Maryland (1957 Edition,
1967 Replacement Volume), title "Motor Vehicles," subtitle "Oper-
ation of Motor Vehicles Upon Highways," TO FOLLOW IMME-
DIATELY AFTER SECTIONS 49, 296A AND 312 RESPEC-
TIVELY, TO REQUIRE MANUFACTURERS TO FILE A
SURETY BOND IN CERTAIN CIRCUMSTANCES, TO PRO-
VIDE THE MANUFACTURER WILL BE JOINTLY AND SEV-
ERALLY LIABLE WITH THE DEALER FOR BREACH OF
WARRANTY, to provide for an increase in the motor vehicle
dealer's and salesman's bond; to require that licenses issued to
automobile dealers be issued to individuals rather than partner-
ships or corporations; establishing failure to adhere to the condi-
tions of a warranty or guarantee by a motor vehicle MANUFAC-
TURER OR dealer as a prohibited act; making it unlawful to sell,
offer for sale, or to operate or equip a vehicle with regrooved or
recut tires and providing criminal penalties therefor; and making
it unlawful to tamper with or alter the odometer of a motor vehicle
and providing criminal penalties therefor; and relating generally
to motor vehicles in this State.

Section 1. Be it enacted by the General Assembly of Maryland,
That Subsections (a) (1) (vi) and (b) (2) (ii) of Section 61 of
Article 66˝ of the Annotated Code of Maryland (1957 Edition.
1967 Replacement Volume, 1969 Supplement), title "Motor Vehicles,"
subtitle "Administration—Registration—Titling," be and they are
hereby repealed and re-enacted, with amendments; and that new
Subsections 61 (a) (5) and 61 (d) (4) (xiv) be added to Section 61
of Article 66˝ of the Annotated Code of Maryland (1957 Edition,
1967 Replacement Volume and 1969 Supplement), title "Motor Ve-
hicles," subtitle "Administration—Registration—Titling," TO FOL-
LOW IMMEDIATELY AFTER SUBSECTIONS 61 (A) (4) AND
61 (D) (4) (XIII) RESPECTIVELY and that new Sections 50,
296B and 312A, be added to Article 66˝ of the Annotated Code of
Maryland (1957 Edition, 1967 Replacement Volume), title "Motor
Vehicles," subtitle "Operation of Motor Vehicles Upon Highways,"
TO FOLLOW IMMEDIATELY AFTER SECTIONS 49, 296A, AND
312 RESPECTIVELY, all to read as follows :

EVERY MANUFACTURER TRANSFERRING A NEW CLASS
A MOTOR VEHICLE TO A DEALER PURSUANT TO THE
PROVISIONS OF SECTION 49 OF THIS ARTICLE OR A USED
CLASS A MOTOR VEHICLE SUBJECT TO A MANUFAC-
TURER'S EXPRESS OR IMPLIED WARRANTY SHALL FILE
WITH THE DEPARTMENT ACCEPTABLE EVIDENCE OF A
