APPROVAL OF THE GOVERNOR, AND SHALL SERVE AT THE
PLEASURE OF THE SECRETARY. THE STATE HIGHWAY
ADMINISTRATOR SHALL RECEIVE SUCH SALARY AS PRO-
VIDED IN THE STATE BUDGET. THE STATE HIGHWAY AD-
MINISTRATOR SHALL REPORT DIRECTLY TO THE SECRE-
TARY OF TRANSPORTATION. THE STATE HIGHWAY
ADMINISTRATOR SHALL, SUBJECT TO THE AUTHORITY OF
THE SECRETARY OF TRANSPORTATION, BE RESPONSIBLE
FOR CARRYING OUT THE POWERS, DUTIES, RESPONSIBILI-
TIES AND FUNCTIONS VESTED BY LAW IN THE STATE
HIGHWAY ADMINISTRATION EXCEPT FOR THOSE POWERS,
DUTIES, RESPONSIBILITIES AND FUNCTIONS VESTED BY
LAW IN THE REGIONAL MEMBERS OF THE STATE ROADS
COMMISSION.
208.
(a) The Secretary of Transportation shall be responsible for
the operation of the Department of Transportation, and shall estab-
lish guidelines and procedures to promote the orderly and efficient
administration thereof.
(b) The Secretary of Transportation shall be responsible for
promulgating rules and regulations for his office. He shall review
and shall have the power to approve, disapprove or revise the rules
and regulations of all of the administrations, boards, commissions,
offices and other agencies within the jurisdiction of the Department
of Transportation, except as provided in Section 208C of this Article.
(c) In addition to the Maryland Transportation Commission
established pursuant to Section 208D of the THIS Article, the Secre-
tary of Transportation may, in his discretion, create such advisory
boards of such size as he deems appropriate.
(d) The Secretary of Transportation may assign and reassign
functions, staff, funds, responsibilities, duties and powers from any
one Administration, Commission or Agency within the Department
of Transportation to any other Administration, Commission or
Agency within the Department, or from any Administration, Com-
mission or Agency within the Department to his own office. WHEN-
EVER AN ASSIGNMENT OR REASSIGNMENT OF FUNCTIONS,
STAFF, RESPONSIBILITIES, DUTIES AND POWERS OCCURS,
THE APPROPRIATION FOR SUCH FUNCTIONS, STAFF, RE-
SPONSIBILITIES, DUTIES AND POWERS SHALL ALSO BE
TRANSFERRED. However, this subsection shall not apply to the
functions and powers of the State Roads Commission set forth in
Article III, Section 40B, of the Maryland Constitution, and it shall
not apply to the functions, responsibilities, duties and powers of the
Maryland Airport Zoning Board, the Airport Zoning Commission, the
Board of Airport Zoning Appeals, the Unsatisfied Claim and Judg-
ment Fund Board, the Board of Review of the Department of Trans-
portation and the Maryland Transportation Authority.
(e) The appointment or removal of personnel by any administra-
tion, commission, board or other agency within the Department of
Transportation shall be subject to the approval of the Secretary of
Transportation; however the Secretary is authorized to delegate this
power of approval to the heads of the administrations, commissions,
boards or other agencies within the Department of Transportation.
