CHAPTER 518
(House Bill 1300)

AN ACT to repeal and re-enact, with amendments, Section 15-4 of
the Code of Public Local Laws of Baltimore City (1969 Edition,
being Article 4 of the Code of Public Local Laws of Maryland),
title "Baltimore City," subtitle "People's Court," amending the
local laws concerning the People's Court of Baltimore City in order
to make various changes in the provisions of the pension system
for judges of said court by creating a contributory pension system
and establishing the rate on which said judges' pensions are
based and the ceiling presently placed thereon, and to amend the
provisions for the payment of said pensions and benefits by the
Mayor and City Council of Baltimore.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 15-4 of the Code of Public Local Laws of Baltimore
City (1969 Edition, being Article 4 of the Code of Public Local Laws
of Maryland), title "Baltimore City," subtitle "People's Court," be
and it is hereby repealed and re-enacted, with amendments, to read
as follows:

15-4.

Every elected judge of the People's Court of Baltimore City shall
be paid, after the termination of his active service if he is then at
least sixty years of age or when he becomes sixty years of age, a pen-
sion or salary calculated at the rate of six hundred dollars ($600.00),
per annum for each year or any part thereof of active service by
appointment and election as a Judge of said People's Court, up to
and including twenty years of such active service, so that the maxi-
mum pension or salary for such service payable hereunder to any
one person shall not exceed the sum of twelve thousand dollars
($12,000.00) per annum. This section shall apply to any elected
judge already retired from active service. Any former judge who
accepts any salaried public office or position, municipal, county, state
or federal, shall not be paid any such pension or salary so long as
he remains in any such office or position. No pension shall be payable
hereunder to any retired judge of the People's Court of Baltimore
City who is receiving another pension under the Employees' Retire-
ment system of the City of Baltimore. [The Mayor and City Council
of Baltimore are hereby expressly authorized to levy for and pay
such pensions or salaries to former judges of said People's Court of
Baltimore City.] Every judge of the People's Court of Baltimore
City who is in office on June 30, 1970, shall have the option of remain-
ing under the present Retirement Plan or he can elect to receive the
benefits hereinafter provided by this section, namely, after the
termination of his active service, if he is then at least sixty years of
age or when he becomes sixty years of age, a pension or salary in an
amount equal to sixty per cent (60%) of his maximum salary, or
one-sixteenth (1/16) of 60% of said maximum salary per annum for
each year or any part thereof of active service by appointment and
election if he has served less than sixteen years as a judge of said
People's Court. This section as herein amended shall apply to any
elected judge already retired from active service, on and after July
1, 1970, provided notice in writing has been given to the Director of
