Therfore it is considered by this Court that Plt Capt Edw
Sweatnam doe Recover from the said Defend.ts in their said
capacities as well the sd sume of Two Thowsand Eight hundred
and Eighty poundes of Tobaccoe the sume of Two
hundred ^Ninety^ and Five poundes of Tobaccoe cost of suit

unto the sheerif of Kent County that he take James Smith if he
should be found in his Bailiwick and him safe Keepe soe that he
have his Body before his Maj.ties Justices att the Next Court to
Answer unto Eliz.a and Thomas Coursey Ex.rs of Coll Henry Coursey
of a plea of Debt

Att which Court viz the 22.th day of June Anno Dom 1697
the day of Returne of sd Writt came Capt Edward Sweatnam high
sheerif of sd County and made returne of sd Writt in these Wordes
viz Cepi Corpus p Edw Sweatnam sheft

On which day the sd Defend.t James Smith by Richard Macklin his
Attorney appeared

And now here att this day viz the 25.th day of August Anno
Dom 1697 came as Well the said Plts by Thomas Coursey their
attorney as allsoe the sd Defend.t by Richard Macklin his sd att.ry
and the said cause standing for Tryal

he render them the full and just sume of Four hundred poundes of good
sound Merch.table  ^leaf^ Tobaccoe in cask convenient on Chester River in
said County which from them he unjustly deteineth

And Wherupon the said Eliz.a and Thomas in their Capacities by the
said Thomas Coursey saith that wheras the said James on the 18.th
day of August Anno 1691 in Kent County within the Jurisdicon of
this Court by his certain bill or Writing obligatory sealed w.th
