the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. Smith Horsey nor but that the
writing Obligatory afd. is the deed of him the Said Bell nor but that he Oweth the Same Smith the afd. Forty Six pounds one
Shilling and Six pence Curt Money in Manner and form as the afd. Smith Above Against him hath declared
      Therefore it is Considered that the afd. Smith Horsey Recover Against the afd. Bell Maddox his debt afd. and his
261 1/4    Damages by Occasion of the detention of that Same debt to                                     Pounds of Tobacco to the
Same Smith of his Assent by the Court here Adjudged And the afd. Bell in Mercy &c.

@         Command was given to the Sheriff of Somerset County that he Should take Richard
prso    Richard Waller    Waller Late of Somerset County Blacksmith Otherwise Called I Richard Waller of Dorchester County in
the province of Maryland Blacksmith if he Should be found in his Bailywick and him Should Safe keep so that he
might have his body before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town
the third Tuesday of March Anno Dom. one thousand Seven hundred and Sixty One to Answer unto Mary
Ennals Executrix and William Ennals Executor of the testament and Last will of Joseph Ennals (of Dorchester County
deceased) of A plea that he Render unto them the Sum of Twenty one pound Seven Shillings and four pence Curt Money of
Maryland which from them he unjustly detains and So forth    And the Same day is Given to the afd. Mary & William
here &c.       Att which day here Came the afd. Mary and William Exrs. as afd. by William Hayward their Attorney
And the Sheriff to witt John Dennis Gent now here Returned that he had taken the afd. Richard Waller whose body
here at this day he had Ready to Answer the afd. Mary and William Exrs. as afd. of the afd. plea as to him it was
Commanded
                  Whereupon the Said Mary and William Ennals Exrs. as afd. declared Against the afd. Richard
Waller in the plea afd. in form following    Somerset to wit Richard Waller Late of Somerset County Blacksmith
Otherwise Called I Richard Waller of Dorchester County in the province of Maryland Blacksmith was Summoned
to Answer unto Mary Ennals Executrix and William Ennals Executor of the testament and Last will of Joseph
Ennals of Dorchester County deceased of A plea that he Render them twenty One pounds Seven Shillings and
four pence Curt. money of Maryland which from them he unjustly detains and So forth
      And Whereupon the Said Mary and William by William Hayward their Attorney Say that Whereas
the Said Richard in the Lifetime of the Said Joseph to wit on the Sixth day of August in the Year of our Lord one
thousand Seven hundred and fifty four at Dorchester to witt at Somerset County afd. by his Certain Writing Obligatory
which the Said Joseph with the Seal of the Said Richard Sealed here into Court doth bring the date whereof is the Same
day and Year afd. Acknowledged himself to be held and firmly Bound unto the Said Joseph in his Lifetime in the
afd. Sum of Twenty One pounds Seven Shillings and four pence Curt Money of Maryland to be paid to the Said
Joseph Ennalls his heirs Exrs. Admrs. or Assigns when he the Said Richard Should be thereto Afterwards Required
Nevertheless the afd. Richard altho often Required the afd. Sum of Twenty One pound Seven Shillings and four pence
Curt. money afd. unto the afd. Joseph in his Lifetime unto the afd. Mary and William or Either of them Since the death
of the Said Joseph hath not paid but the Same to them or Either of them to pay hath Refused and unjustly detained to
the manifest delay of the Execution of the Last Will and Testament of the afd. Joseph Whereupon the Said Mary
And William Say they have Damage to the Value of Twenty One pound Seven Shillings and four pence Curt Money of
Maryland and thereof they Bring Suit and So forth and Bring here into Court the Letters Testamentary of the afd. Joseph
by which it fully Appeareth to the Court here that the Said Mary is Executrix and the Said William Executor of the testament
and Last will of the afd. Joseph and have thereof Administration &c.                          Pledges &c. J. Doe & R Roe
   And the afd. Richard Waller in his proper person Cometh and defendeth the force and Injury when &c. And Saith
that he Cannot deny the Action afd. of the afd. Mary & William Ennals Exrs. as afd. nor but that the Writing Obligatory afd.
is the deed of him the afd. Richard Waller nor but that he detains from the afd. Exrs. the afd. Twenty One pound Seven
Shillings and four pence Curt Money in Manner and form as the afd. Mary & William Exrs. as afd. Above Against
him hath declared       Therefore it is Considered that the afd. Mary & William Ennals Exrs. as afd. Recover Against
the afd. Richard Waller his debt afd. and his Damages by Occasion of the detention of that Same debt to
