Att which day here came as well the afsd John Scarborough as the afsd: George Buchanan & William
Hamilton by their Attorneys afsd & the afsd: George and William Suggest to the court here that they
have a Material Witness in this cause who is now beyond the seas without whom they cannot safely come
to tryall and the afsd: sheriff did not send thereof the writt &c       Therefore as before it is command-
-ed the sheriff of Somerset County that he should cause to come before his Lordships Justices at the
Next Court to beheld at princess Ann Town the third tuesday of November then next follow
ing twelve &c. by whom &c. and who neither &c to Recognize in form afsd: & the same day is given to the parties
afsd: here &c         Att which day here came as well the afsd: John Scarborough as the afsd George Bu-
-chanan & William Hamilton by their Attorneys afsd: and the afsd: George and William suggest to
the Court here that they have a Material Witness in this Cause who is now beyond the seas with-
-out whom they cannot safely come to tryall and the afsd sheriff did not send thereof the writt &c
Therefore as before it is commanded the sheriff of Somerset County that he should cause to come
before his Lordships Justices at the next Court to be held at princess Ann Town the third tuesday of
March then next following Twelve &c by whom &c and who neither &c to Recognize in form afsd &c &
the same day is given to the parties afsd here &c.         Att which day here came as well the afsd:
