Ponsonby Says he is Worse and hath Damage to the Value of Ten pounds Curt Money of Maryland and thereof he brings

                       Errors Excepted pr Levin Gale for John Ponsonby
And the afd. John Whittingham by his Attorney afd. Comes and defends the force and Injury when &c. And Saith that he
Cannot deny the Action afd. of the afd. John Ponsonby nor but that he did Assume upon himself in Manner and form as
the afd. Ponsonby Above Against him hath Complained and as to the damage of the Said Ponsonby by him by Occasion of
the Premisses the Said John Whittingham Saith and Acknowledgeth that the afd. Ponsonby hath Sustained Damages
by Occasion of the Premisses beyond his Costs and Charges by him about his Suit in that part Apposed to Two pounds
fifteen Shillings Curt Money and not more and because the afd. Ponsonby denys not this but the Same Allegation
Grants to be true Prays Judgment for those damages Above Acknowledged together with his Costs and Charges afd. to him to
be Adjudged &c    Therefore by Consent of the parties afd. it is Considered that the afd. John Ponsonby Recover
Against the afd. John Whittingham his Damages afd. to the afd. Two pounds fifteen Shillings Curt Money by the Same
Whittingham in form afd. Acknowledged as also                                                    Pounds of tobacco for his Costs
and Charges afd. to the Same Ponsonby at his Request by the Court now here of the Assent of the parties afd. Adjudged
which Certain Damages in the Whole Amount to Two pounds fifteen Shillings Curt Money and

@    Command was Given to the Sheriff of Somerset County that he Should take Mitchell King
SW    Mitchell King    Late of Somerset County Planter Otherwise Called I Mitchell King of Somerset County in the Province of Maryland
if he Should be found in his Bailywick and him Should Safe keep so that he might have his body before the Justices of his
Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of March Anno Dom. one thousand
Seven hundred and Sixty Two to Answer unto John Adams of A plea that he Render him the Sum of forty Pounds Curt Money of
Maryland which to him he Owes and unjustly detains and So forth and the Same day is Given to the afd. John here &c
        Att which day here Came the afd. John Adams by George Hayward his Attorney and the Sheriff to witt Ephraim
Wilson now here Returned that he had taken the afd. Mitchell King whose body here at this day he had Ready to
Answer the afd. John Adams of the afd. plea as to him it was Commanded
           Whereupon the Said Mitchell King at the prayer of the afd. John Adams is Adjudged to Give Special
Bail to the Action afd. Thereupon a Certain Richard Waller of Somerset County Blacksmith present here in Court
in his proper Person undertook for the Said Mitchell King and Assumed upon himself that if it Should happen that
Judgment in the plea afd. Should be Rendred for the Said John Adams Against the afd. Mitchell King or that he the
Said Mitchell King Should be therein Convict that then he the Said Mitchell King Should pay and Satisfie unto the
afd. John Adams the Judgment of the Court thereupon or Render his body in Execution of Such Judgment to the
Prison of the Sheriff of the County afd. in Satisfaction thereof or that he the Said Richard Waller will do the Same
for him &c.       Whereupon the Said Mitchell King puts in his place Samuel Wilson Gent Attorney at Law Against
the afd. John Adams in the afd. plea       And thereupon at the prayer of the parties afd. day is to them now here
Given untill next Court to be held at Princes Ann Town the third Tuesday of June then next following in that State
that now Saving to the Parties afd. &c.       Att which day here Came as well the afd. John Adams as the afd. Mitchell
King by their Attorneys afd. And hereupon the Said John declared Against the afd. Mitchell in the plea afd. in
form following Somerset fst Mitchell King Late of Somerset County Planter Otherwise Called I Mitchell King
of Somerset County in the Province of Maryland Planter was Summoned to Answer unto John Adams of A plea of
trespass upon the Case that he Render him the Sum of forty Pounds Curt. Money of Maryland which to him he
Owes and unjustly detains and So forth       And Whereupon the Said John by George Hayward his Attorney
Says that Whereas the Said Mitchell on the viii day of February Anno Dom. MDCCLXii at Somerset County
afd. by his Certain Writing Obligatory which the Said John with the Seal of the Said Mitchell Sealed hereto the
