	@	Command was given to the Sheriff of Somerset County that he Should take John Benson Late of
GH	John Benson	Somerset County Bricklayer if he Should be found in his bailywick and him Should Safe keep so that he might have his body

before the Justices of his Lordships County Court of Somerset to be held at Princes Ann Town the third Tuesday of March Anno
Dom. one thousand Seven hundred and Sixty Two to Answer unto John Gale and John Ponsonby of a plea of trespass upon the
Case &^c. And the Same day is Given to the af^d. Gale and Ponsonby here &^c
           Att which day here Came the af^d. Gale and Ponsonby by W^m. Hayward their Attorney and the Sheriff to witt
Ephraim Wilson now here Returned that he had taken the af^d. John Benson whose body here at this day he had Ready to
Answer the af^d. Gale and Company of the af^d. plea as to him it was Commanded
           Whereupon the Said John Benson at the prayer of the af^d. Gale and Ponsonby is Adjudged to Give
Special Bail to the Action af^d. Thereupon a Certain William Catlin of Somerset County planter Present here in Court
in his Proper Person undertook for the Said John Benson and Assumed upon himself in Manner and form as the af^d.
Gale and Ponsonby ab that if it Should happen that Judgment in the plea af^d. Should be Rendred for the Said Gale &
Ponsonby Against the af^d. John Benson or that he the Said John Benson Should be therein Convict that then he the
Said John Benson Should pay and Satisfie unto the af^d. Gale and Ponsonby the Judgment of the Court thereupon or
Render his body in Execution of Such Judgment to the Prison of the Sheriff of the County af^d. in Satisfaction thereof
or that he the Said W^m. Catlin will do the Same for him &^c.
           Whereupon the Said John Benson puts in his place George Hayward Gen^t Attorney at Law
Against the af^d. Gale and Ponsonby of the af^d. plea
           And thereupon at the prayer of the parties af^d. day is to them now here Given untill next
Court to be held at Princes Ann Town the third Tuesday of June then next following in the State that now Saveing to
the parties af^d. &^c.    Att which day here Came the parties af^d. by their Attorneys af^d. And hereupon the Said Gale and
Ponsonby Complained of the af^d. John Benson in the plea af^d. in form following
      Somerset fs^t John Benson Late of Somerset County Planter was Attached to Answer unto John Gale and John
Ponsonby of A plea of trespass upon the Case &^c.    And Whereupon the Said Gale and Ponsonby by William
Hayward their Attorney Complain that Whereas the Said John the Twelfth day of April in the Year of our Lord One
thousand Seven hundred Sixty at the County af^d. was Indebted unto the Said Gale and Ponsonby in the Sum of Two Pounds
Sixteen Shillings and one Farthing Current money of Maryland for the Sundry Articles and things in the Account hereto
Annexed Mentioned and So thereof Indebted being the Said John in Consideration thereof Afterwards to wit the Same
day and Year af^d. at the County af^d. upon himself Assumed and to the Said Gale and Ponsonby then and there faithfully
Promised that he the Said John the Sum of Money af^d. when he Should be thereto Required to the Said Gale and
Ponsonby well and faithfully would pay and Content Nevertheless the Said John his Promise and Assumption af^d.
in form af^d. made Little Regarding but minding and fraudulently Intending the Said John Gale and Ponsonby in that part
Craftily and Subtilly to deceive and defraud the Sum of Money af^d. unto the Said Gale and Ponsonby hath not paid or
them for the Same in Any Sort Contented (Altho the Same to do the Same John afterwards to wit the Same day and Year af^d.
and often Since at the County af^d. by the Said Gale and Ponsonby was Required) but the Same to them to pay hitherto
altogether hath Refused and Still doth Refuse and unjustly deny whereupon the Said Gale and Ponsonby Say they
are worse and have Damage to the Value of Twenty Pounds Cur^t Money of Maryland and thereof they Bring Suit and
