	@	Command was given to the Sheriff of Somerset County that he Should take
LD WH	Ambros Fitzwaters	Ambros Fitzwaters Late of Somerset County Planter if he Should be found in his Bailywick

and him Should Safe keep so that he might Have his body before our Justices of our County Court of Somerset to
be held at Princes Ann Town the third Tuesday of June Anno Dom. one thousand Seven hundred and Sixty
One to Answer unto John Donohoe of A plea of trespass upon the Case and So forth And the Same day is
Given to the af^d. John here &^c       Att which day here Came as well the af^d. John Donohoe by George
Hayward his Attorney and the Sheriff to witt John Dennis Gen^t now here Returned that he had taken the af^d.
Ambros Fitzwaters whose body here at this day he had Ready to Answer the af^d. John Donohoe of the af^d.
plea as to him it was Commanded       Whereupon the Said Ambros Fitzwaters at the prayer of the af^d. John
Donohoe is Adjudged to give Special Bail to the Action af^d. Thereupon a Certain James Knight of Somerset County
Planter Present here in Court in his Proper Person undertook for the Said Ambros Fitzwaters that if it Should
happen that Judgment in the plea af^d. Should be Rendred for the Said John Donohoe Against the af^d. Ambros
Fitzwaters or that he the Said Ambros Fitzwaters Should be therein Convict that then he the Said Ambros
Should pay and Satisfie unto the af^d. John the Judgment of the Court thereupon or Render his body in Execution
of Such Judgment to the Prison of the Sheriff of the County af^d. in Satisfaction thereof or that he the
Said James Knight will do the Same for him &^c
           Whereupon the Said Ambros Fitzwaters puts in his place William Hayward Gen^t Attorney at
Law Against the af^d. John Donohoe of the af^d. Plea
      And thereupon at the prayer of the Parties af^d. day is to them now here Given untill next Court to be
held at Princes Ann Town the third Tuesday of August then next following in the State that now Saveing to
the Parties af^d.       Att which day here Came the parties af^d. by their Attorneys af^d. And hereupon the Said
John Complained Against the af^d. Ambros in the plea af^d. in form following
Somerset fs^t Ambros Fitzwaters Late of Somerset County Planter was Attached to Answer unto John Donohoe
of A plea of trespass upon the Case and So forth    And Whereupon the Said John by George Hayward his
Attorney Complains that whereas the Said John is a quiet and peaceable Subject of our Lord the King that now is
Nevertheless the Said Ambros not Ignorant of the Premisses but Plotting and Malitiously Intending the
Said John not only in his Peaceable Reputation to deprive but also to Cause him to be Seized Imprisoned and
Great Expence Cost and Trouble on him to be Imposed on the         day of         in the Year of our Lord One thousand
Seven hundred and           at Princes Ann Town in the County af^d. before the Worshipfull Isaac Handy Esq^r &
Others his Associates the Right Hon^rble the Lord Prop^ry his Justices in and for the County af^d. the peace to keep
Assigned then and there in a County Court in and for the Said County Judicially Sitting falsly and Malitiously
and without any Just Legal and Probable Cause procured the following false and Malitious Indictment Against
the Said John Cause to be drawn and put into Writing Containing the false and Malitious Matter following
to witt Somerset to wit the Jurors for his Lordship the Right Hon^rble the Lord Prop^ry that now is for the body
of Somerset County upon their Oath Present that John Donohoe Late of Coventry Parish in the County af^d.
Planter on the xx day of March Anno Dom. MDCCLX at the Parish af^d. in the County af^d. in and upon a Certain
Ambrose Fitzwaters in the peace of God and the Said Lord Prop^ry then and there being an Assault did Make
And him the Said Ambros then and there did beat Wound and Evilly treat So that of his Life it was Much
dispaired and other harms to him the Said Ambros then and there did to the Great Damage of the Said Ambrose
