Saith that he Cannot deny the Action afd. of the afd. John White nor but that he did Assume upon himself in Manner
and form as the afd. John White Above Against him hath Complained and as to the damage of the Same John
White by him by Occasion of the Premisses in that part Sustained the Same John Whittingham Saith and
Acknowledgeth that the afd. John White hath Sustained Damages by Occasion of the Premisses beyond
his Costs and Charges by him about his Suit in that part Apposed to Ten pounds five Shillings Curt Money
And not More and because the afd. John White denys not this but the Same Allegation Grants to
be true prays Judgment for those damages Above Acknowledged together with his Costs and Charges afd. to
him to be Adjudged &c.    Therefore by Consent of the Parties afd. it is Considered that the afd. John White
Recover Against the afd. John Whittingham his Damages afd. to the afd. Ten pounds five Shillings Curt Money by
234    the Same John Whittingham in form afd. Acknowledged as also                                          Pounds of
Tobacco for his Costs and Charges afd. to the Same White in form afd. Acknowledged as also at his Request by
the Court now here of the Assent of the Parties afd. Adjudged which Certain Damages in the Whole Amount to
Ten pounds five Shillings Curt Money and                                               Pounds of Tobacco and the afd. Whittingham
in Mercy &c.

@    Command was given to the Sheriff of Somerset County that he Should take
LD    Ann Records    Ann Records Late of Somerset County Spinster if he Should be found in his bailywick and
him Should Safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset
to be held at Princes Ann Town the third Tuesday of June Anno Dom. One thousand Seven hundred and Sixty
One to Answer unto James Hitch of A plea of Covenant broken and So forth    And the Same day is Given to the
afd. James here &c    Att which day here Came the afd. James Hitch by his Attorney afd. And the Sheriff to witt
John Dennis Gent now here Returned that he had taken the afd. Ann Records whose body here at this
day he had Ready to Answer the afd. James Hitch of the afd. plea as to him it was Commanded
           Whereupon the Said Ann Records At the prayer of the afd. James Hitch is Adjudged to Give
Special Bail to the Action afd.    Thereupon a Certain Richard Waller and John Carmichael of Somerset
County Planter Present here in Court in their Proper Persons undertook and Each of them undertook for the
Said Ann Records that if it Should happen that Judgment in the plea afd. Should be Rendred for the
Said James Hitch Against the afd. Ann Records or that she the Said Ann Records Should be therein
Convict that then She the Said Ann Should pay and Satisfie unto the afd. James Hitch the Judgment
of the Court thereupon or Render her body in Execution of Such Judgment to the Prison of the Sheriff of
the County thereupon or Render her body in Execution of Such Judgment to the Prison of the Sheriff of
the County afd. in Satisfaction thereof or that they the Said Richard Waller and John Carmichael
will and Each of them will do the Same for her &c
      Whereupon the Said Ann Records puts in her place Littleton Dennis Gent Attorney at Law Against the afd.
James Hitch of the afd. plea
   Whereupon the Said At the prayer of the parties afd. day is to them now here Given untill next Court to be held
at Princes Ann Town the third Tuesday of August then next following in the State that now Saveing to the parties
afd. &c.       Att which day here Came the Parties afd. by their Attorneys afd. And hereupon the Said James
Hitch Complained of the afd. Ann Records in the plea afd. in form following
Somerset fst Ann Records Late of Somerset County Spinster was Summoned to Answer unto James Hitch of
a plea of Covenant broken and So forth       And Whereupon the Same James by Wm. Hayward his Attorney
Says that whereas the Said Ann on the Ninth day of September in the Year of our Lord One thousand Seven
hundred and Sixty at Somerset County afd. by his Certain Writing Sealed with her Seal and here in Court
Produced bearing date the Same day and Year did Covenant and Oblige herself to pay or Cause to be paid unto
the Said James Hitch his heirs Exrs. Admrs. or Assigns the full and Just Sum of Seventy five pounds Curt Money
of Maryland at or upon the first day of March Next Ensuing the date of the Same Writing with Legall
