Meet on the afd. Land Called Davids Destany or Any other Land on which the bounds of the afd. Land may
Depend You first haveing taken your Oaths on the holy Evangelist of Almighty God and there Cause to Come
before you or any three or two of you all Such Evidences as Shall be to You or Any three or two of You
Nominated by the Said Complainant or Deft and that you or Any three or two of you Examine them
upon their Corporall Oaths to be by you or Any three or two of You Administred on the holy Evangelist
of Almighty God in the Presents of the Complainant or Deft. if Any touching the truth or Remembrance
of their knowledge or Any thing that may Relate to the Cause afd. and that Reduceing the Severall
Depositions into Writing you Send the Same with this our Commission under your or Any three or two of your
hands and Seals to us to our County Court of Somerset with all Convenient Speed Witness Isaac Handy
Esqr one of our Justices of our Said Court the 20th day of August Anno Dom. 1761
        And now to witt at a Court of his Lordship held at Princes Ann Town the third Tuesday of March
being the Sixteenth day of the Same Month Anno Dom. 1762 before the Justices thereof Came the afd.
Joseph Gilliss and Whitey McClemey two of the Gentlemen nominated in the within Commission and Returned the
Same Endorsed in Manner following Vizt       3d of Octr. 1761 Then was Capn. Joseph Gillis and Mr. Whitey
McClemey Quallified to Execute the within Commission Agreeable to an Act of Assembly in Such Case made &
Provided the day and Year above           &2                          before       Thos. Jones
   November ye 25th: 1761 The Deposition of William Pollet Aged forty One years or thereabouts being Sworn on the
holy Evangelist of Almighty God deposeth and Saith that about five or Six Years Agoe he was with Mathew
Wallace and Some others at an old Cow bridge about One hundred and fifty Yards South or near that Course and
Distance from the first bounder of James's delight belonging to Francis White that he the Deponant heard
the Said Wallace Say that that was the head of the Creek and that One Jones Cut a ditch from that Bridge
up near to the house where he Lived and further Saith not
   The Deposition of William Polk Aged thirty Two years or thereabouts being Sworn on the holy Evangelist
of Almighty God Deposeth and Saith that five years agoe or thereabouts that he was Executing a Warrant of
Resurvey between Wm. Roberts Plfe. and Mathew Wallace Defe. that he begun at a post the first bounder of
a tract of Land Called Davids Destany as Shewn by the Plfe. and Run the Course Agreeable to the Grant untill
he Came to a Creek Called Balls Creek as Aledged by the Plfe. Wm. Roberts and this Deponant further Saith that
he heard Mathew Wallace Say and pointed to the Southward that was a ditch Cut and further Saith not which
was near the Bridge mentioned in Wm. Pollets deposition and further Saith not
   The Deposition of Francis Roberts Aged thirty Years or thereabouts being Sworn on the holy Evangelist
of Almighty God deposeth and Saith that about five years agoe he was present when Wm. Polk made the
Resurvey on Wm. Roberts Land and he heard Mathew Wallace Say that Where the old Cow bridge was
(Mentioned in Wm. Pollets Deposition) was the head of the Creek and that old Samuel Jones he that did Own
that Brick Chimney Dug this a ditch to this place and further Saith not
   The Deposition of Francis White Aged thirty Eight Years or thereabouts being Sworn on the holy
Evangelist of Almighty God deposeth and Saith that he heard his father Say that old Samuel Jones
Dug a ditch into the head of Bolls Creek and further Saith not
We the Subscribers do hereby Certifie that we have Executed the above Commission According to An Act
of Assembly in Such Case made and Provided and taken these four depositions thereto Annexed
