November Court 1761 117 And Princes Ann Town the third Tuesday of June then next following in the State that now Saveing to the Parties afd. Att which day here Came the Parties afd. by their Attorneys afd. And hereupon the Said Mary and William Ennalls declared Against the afd. Christopher Piper in the plea afd. in form following Somerset fst Christopher Piper Late of Somerset County Planter Otherwise Called I Christopher Piper of Somerset County in the Province of Maryland Planter was Summoned to Answer unto Mary Ennalls Executrix and William Ennalls Executor of the Testament and Last Will of Joseph Ennalls of Dorchester County deceased of A plea that he Render unto them the Sum of forty Six Pounds Eleven Shillings and Six pence Curt Money of Maryland which from them he unjustly detains and So forth And Whereupon the Said Mary and William by George Hayward their Attorney Say that whereas the Said Christopher on the Twenty third day of July Anno Dom. MDCCLVii at Dorchester County to wit at Somerset County afd. by his Certain Writing Obligatory Sealed with the Seal of the Said Christopher and to the Court here Shown the date Whereof is the day and Year afd. Acknowledged himself to be held and firmly Bound to the Said Joseph in his Lifetime in the afd. Sum of forty Six Pounds Eleven Shillings and Six pence Curt Money of Maryland to be paid to the Said Joseph when he the Said Christopher Should be thereto afterwards Required Nevertheless the Said Christopher the afd. Sum of Forty Six Pounds Eleven Shillings and Six pence Curt Money afd. altho often Required to the Said Joseph in his Lifetime or to the Said Mary and William after the death of the Said Joseph or to Either of them hath not yet Paid but the Same Christopher the afd. Sum of Forty Six Pounds Eleven Shillings and Six Pence Curt Money afd. to the Said Joseph in his Lifetime and to the Said Mary and William after the death of the Said Joseph hath hitherto Altogether denyed to pay and the Same to the Said Mary and William or to Either of them doth Yet deny to pay to the Damage of the Said Mary and William Forty Six Pounds Eleven Shillings and Six Pence Curt Money of Maryland and thereof they bring Suit and So forth and the Said Mary and William bring here to Court the Letters Testamentary of the afd. Joseph by Which it Sufficiently Appears to the Court here that the Said Mary is Executrix and the Said William Executor of the Last will And Testament of the Said Joseph afd. and thereof hath the Administration Pledges &c. J. Doe & R. Roe And the afd. Christopher Piper by his Attorney afd. Comes and defends the force and Injury when &c And prays Leave thereof to Imparle here untill next Court to be held at Princes Ann Town the third Tuesday of August then next following and he hath it and the Same day is Given to the afd. Mary and William Exrs. here Also &c Att which day here Came as well the afd. by their Attorneys afd. and hereupon the Said Christopher prays further Leave thereof to Imparle here untill Next Court to be held at Princes Ann Town the third Tuesday of November then next following and he hath it and the Same day is Given to the afd. Exrs. here also &c Att which day here Came as well the afd. Mary and William Exrs. afd. as the afd. Christopher by their Attorneys afd. And hereupon the Said Christopher as before defends the force and Injury when &c. And Saith that he Cannot deny the Action afd. of the afd. Mary and William nor but that the Writing Obligatory afd. is the deed of him the Said Christopher nor but that he detains from the afd. Mary and William the afd. forty Six Pounds Eleven Shillings and Six Pence Curt Money in Manner and form as the afd. Mary and William above Against him have Declared Therefore it is Considered that the afd. Mary and William Ennalls Recover Against the afd. Christopher Piper his debt afd. and his Damages by Occasion of the detention of the Same debt to 307: Pounds of Tobacco the Same Mary and William of their Assent by the Court here Adjudged And the afd. Christopher in Mercy &c
