with the said section of the said act, and in case any widow is
entitled to any right of dower in such real estate, so decreed to
be sold, the trustee or trustees appointed in said decree shall
proceed to sell such real estate as is decreed to be sold, accord-
ing to the terms therein prescribed, free and disencumbered of
any right of dower of the said widow in and to the same, and
in consideration thereof the chancellor, or county courts respec-
tively, shall award to such widow such proportion of the pur-
chase money as he or they shall think just and equitable, not
exceeding more than one-seventh part, nor less than one-tenth
part of the net proceeds of the said sales, according to the age,
health and condition, of such widow ; and such award of pay-
ment shall be a sufficient bar to all and every right or title of
dower which such widow may claim in and to such real estate
so as aforesaid sold.

SEC. 2. And be it enacted, That before any sale of land
shall be decreed, to affect the interest of a widow under this
law, her consent in writing shall be filed in the court in which
the case is depending.

AN ACT laying duties on Licenses to Retailers of Dry Goods, and for
other purposes.

SEC. 3. And be it enacted. That it shall be the duty of the
treasurers of the respective shores, under the direction of the
governor and council, to furnish the clerks of the several
counties within this state, with blank licenses, which licenses
shall be signed by the treasurer of the shore where such retail
dealers in merchandize reside, and being countersigned by the
clerk who shall issue the same, shall be granted to any person
who shall desire the same, upon the payment of the sum or
duty payable by this act for such license, and fifty cents to

such clerk for making out or renewing such license ; Provided
always, and it is hereby expressly understood, that the license
so as aforesaid granted shall not be deemed to authorize the
person obtaining the same to sell wines, rum, brandy, whiskey,
or other distilled spirituous liquors.
The proviso is inoperative under 1827, ch. 117, sec. 1.
