2788 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 27]

DELEGATE PENNIMAN: My com-
ment, Mr. Chairman, would be almost
identical with that of Chairman Mudd. It
seems to me that when we say "shall have
been a citizen of the State and shall have
been authorized to practice law", it is clear
that both shall have been for the period of
five years. I do not object to the amend-
ment, except that it seems to me it is
redundant and will add some words to the
constitution that are not needed.

THE PRESIDENT: Is there any fur-
ther discussion? Are you ready for the
question?

The Clerk will ring the quorum bell.

The question arises on the adoption of
Amendment No. 7 to Committee Recom-
mendation JB-1 as amended by Report
S&D-8.

A vote Aye is a vote in favor of Amend-
ment No. 7. A vote No is a vote against.

(Whereupon, a roll call vote was taken.)

THE PRESIDENT: Has every delegate
voted? Does any delegate desire to change
his vote?

(There was no response.)
The Clerk will record the vote.

There being 47 votes in the affirmative
and 55 in the negative, the motion is lost.
The amendment is rejected.

DELEGATE JETT: There is an amend-
ment being printed to section 5.15. I
thought it would be on our desk.

THE PRESIDENT: How long ago was
the amendment sent over to be printed?

DELEGATE JETT: I would say about
a half hour ago.

THE PRESIDENT: This is your amend-
ment, Delegate Jett?

DELEGATE JETT: I do not have it.

THE PRESIDENT: On page 5, line 27,
add a new sentence. Is that the one?

DELEGATE JETT: That is the one.

THE PRESIDENT: Pages please dis-
tribute amendment K. "K" for King.

This will be Amendment No. 8.
The Clerk will read the amendment.

READING CLERK: Amendment No. 8
to Committee Recommendation JB-1, as
amended by Report S&D-8, by Delegates
Jett and Johnson:

On page 5, section 5.15, Nomination and
Appointment, in line 27, after the period
add this new sentence: "If no such list of
nominees is submitted to the Governor
within the time period prescribed, then he
shall appoint an eligible person to fill the
vacancy."

THE PRESIDENT: The amendment is
submitted by Delegate Jett and seconded
by Delegate Johnson. The Chair recognizes
Delegate Jett.

DELEGATE JETT: Mr. Chairman
and fellow delegates, the content of this
amendment is pretty evident on its face.
The intention is to take care of that con-
tingency where the nominating committee
fails to submit a list of nominees. Should
that occur, this amendment provides that
if no list of nominees is submitted to the
governor within the time prescribed, then
he shall appoint an eligible person to fill
the vacancy. We feel that should take care
of it.

We urge the adoption of the amendment.

THE PRESIDENT: Any questions of
the sponsor of the amendment?

Delegate Borom.

DELEGATE BOROM: I would like to
ask Delegate Jett if he wants to insert
this after the period on line 27, or after
the period on line 23.

DELEGATE JETT: We will leave that
up to style, delegate Borom. We had some
question about that ourselves. Our sug-
gestion was that it should go at the end
of 27, but we have no really strong feeling
on that point.
