These resolutions are the ones mentioned in the correspondence between the governors of Maryland and Virginia, which was found in the Boundary Papers. Resolutions scanned and posted at MSA SC 5330-10-19. Located information on the Mitchell map on the Library of Congress web page. Created an entry for it at MSA SC 5330-12-17. Completed scanning, and posted Documents 57, "Continuting in Force the Convention of July 3, 1815", and 58, "Submission to Arbitration of the Northeastern Boundary  Question", from: Miller, Hunter, ed. Treaties and Other International Acts of the United States of America, Volume 3, Documents: 41-79: 1819-35. Also scanned and posted Carrier's article on John Mitchell, and the Huntingfield Corporation map report on the Mitchell map. Scanned opinion by Richard E. Israel, dated March 29, 2002, concerning riparian owners right to "wharf out". Entry for it created at MSA SC 5330-34-1. Also downloaded corresponding Court of Appeals case and Senate Bill. Karen xeroxed research notes pertaining to the river and gambling, while I scanned photographs into Ed's laptop. Upon return to MSA, photographs and notes were uploaded.

Kathy is looking for information about assessment records for Charles and St. Mary's counties and would like to get together about them while preparing an affidavit. Kathy to meet with Ed, Dave, and myself tomorrow morning. Spoke with Ed on the phone several times about security problems and the mdag.net site. Received phone calls from Rosewin and Andy who both needed access to the site. Issued passwords to Rosewin, Andy, and Andrew Snyder. Ed to follow up about security matters. Continued posting images of the ST. MARY'S COUNTY CIRCUIT COURT (License Record), and emailed Rosewin. Reviewed draft of affidavit emailed by Rosewin. Took volume of ST. MARY'S COUNTY CIRCUIT COURT (Liquor License Record) to Imaging Services, to be done ASAP. Drove to Hammonds Ferry to pick up a second volume of liquor licenses. Also, Dave sent a listing of businesses along the Virginia shore that Andy was able to put together from information he obtained from the Charles County Circuit Court.

Emailed Andy Baida with research update. I have continued searching for information about the slot machine case in St. Mary's County, but have been unsuccessful. I had a 1951-1958 docket book from St. Mary's County returned to Annapolis from one of our offsite facilities. What is labeled as a docket seems to be rough minutes. It is arranged chronologically with no index. I also found no mentions of lawyers names or the charges on which a defendant was found/plead guilty. I wonder if the Circuit Court has a separate criminal docket for this time period?

Spent morning going to the Hammonds Ferry warehouse to pick up 2 boxes of minutes from the Charles County Board of County Commissioners. Spent the afternoon looking for selected years of minutes for any information they may give about businesses on the shore. Also searched Lexis and records at MSA for any lawsuits involving these businesses that were filed in Maryland. Met with Karen and Nasim who were examining records from the Comptroller's office. They were unable to locate any additional information about the amusement tax, or any mention of receiving such as tax.

Andy is looking for information regarding tax maps of Charles and St. Mary's counties. Businesses extending from the Virginia shore were being assessed by MD in those counties. Dave and I looked at maps, and discovered that they do not show the Virginia shore. We also briefly looked at assessment records, but will need to know names of businesses and business owners in order to trace back further.

Responded to her with information about the Conservation Commission and other agencies/commissions as outlined in early editions of the Maryland Manual. She wrote back asking about what annual reports for the Board of Natural Resources and the Maryland Geological Survey are available at MSA, and is it would be possible for her to come in and view them tomorrow. Left her a message at home about the volumes in our collections, and that she was welcome to come in and look at them, and that I would be happy to meet with her and go over our finding aids, etc.

Researched legislative history of 1799 Acts of Va Chapter 42 (MSA SC 5330-2-45)
According to the Journal of the House of Delegates of the Commonwealth of Virginia for the 1799 session, the passage of this act is as follows. There is no mention of any similar Maryland legislation, particularly the 1768 act.

"Also, a petition from the President and directors of the Potowmac company praying that a law may pass prohibiting the forming of fish dams or creating any obstruction to the navigation of the river Potowmac, from the little Falls to the Savage river, and in the south branch from the mouth to the highest part to which the navigation can be extended."

The petition referred to the Committee of Propositions & Grievances.

There were two other acts passed that year, Chapter 10 and Chapter 451. All 4 acts were scanned and posted on mdag.net in series 3.

Searched from Maryland and Virginia resolutions of 1801 through 1803 dealing with the appointment of commissioners, as mentioned in Whealton. Scanned and posted a Virginia resolution of 1802 (MSA SC5330-2-73). Also posted a Maryland resolution from the November 1801 session. Research notes are as follows:
n the Novebmer 1801 session, the MD General Assembly passed the following resolution:
RESOLVED, That the governor and council be and they are hereby authorized and required to appoint three proper persons as commissioners on the part of this state, to meet such commissioners as may be appointed for the same purpose by the commonwealth of Virginia, to settle and adjust, by mutual compact between the two governments, the western and southern limits of this state, and the dividing lines and boundaries between this state and said commonwealth, and also to settle and adjust as aforesaid any claim of this state, or the said commonwealth, to territory within the limits of the other; and the said commissioners, so to be appointed, are hereby required to report their proceedings in virtue of their said appointment and authority to the general assembly of this state, at their next session after the same shall have been concluded for confirmation.

This resolution corresponds with other resolutions passed by Maryland in 1795 and 1796. I have edited the entry at MSA SC5330-3-31 so that it now links to the 1801 resolution.

Virginia passed the following the following Act during the Dec 1801 session. VA Acts 1801 Chapter 26 is entitled:
"An Act Authorizing the executive to make compensation to certain commissioners" 2 Shepherd 333.
As the title implies, this act deals only with compensation of commissioners, not the appointment of such, therefore I have not scanned it for mdag.net. Let me know if you would like it to be.

Virginia then passed a resolution in February 1802, relative to commissioners to be appointed by the executive whenever others appointed by Maryland to adjust western boundary of said state. 2 Shepheard 395-396.

Also searched for any possible papers from the Provincial Court which may have prompted an opinion from Daniel Dulany concerning fishing rights and the Maryland Charter (see MSA SC5330-16-299 for his complete opinion). The Dulany opinion in 1 Harris & McHenry is not associated with any cases in that volume. The introduction says that they compiled significant documents "in different parts of the state" from the colonial period and included them in this volume. There is no reference as to where this opinion came from, or the parties in a particular case. Opinions directly related to recorded cases in 1 H & McH are recorded with the case, not separately in the appendix. Rocky and I have examined the PROVINCIAL COURT (Judgment Records) page by page from three terms without any luck. We also searched AOM in case it was part of council proceedings, but no success. This opinion may be a part of the Dulany papers at the Maryland Historical Society. Rocky believes the opinion is not directly related to a suit, and perhaps not a suit in Maryland.

Looked through House proceedings for November 1793 and 1794 sessions for references to the Potomac and/or Virginia. No references found to any acts or resolutions in Maryland in response to Virginia's act of 1793 regarding the licensing of vessels on the Potomac (VA Acts 1793 Chapter 24, MSA SC5330-2-44). MD Acts 1794 Chapter 29 is entitled "An Act relating to the Patowmack Company, and the navigation of the Patowmack River." It does not appear to be a
response to the VA Acts 1793 Chapter 24. The text of the Virginia act addresses the licensing of vessels, which is not mentioned at all in the Maryland act. The Maryland act is basically extending the powers of the Potomac Company, and the time frame for the completing the navigation of the Potomac. Another Virginia act of 1793 does seem to correspond with this Maryland one, as it also discusses extending the time period for navigation. VA Acts 1793 Chapter 27, "An ACT to repeal in part, "An act concerning the Patowmack company, and for other purposes" appears on mdag.net under SC5330-2-19. The 1794 Maryland act may be a response to this.

Continued reading CHANCERY COURT (Chancery Papers) The Baltimore and Ohio Rail Road Company v. the Chesapeake & Ohio Canal Company, File 6299, MSA S512-761, MdHR 17,898-6299-10, 1/37/3/17.  There were no mentions of the Compact of 1785. Compacts in general are discussed in the Defendant's rejoiner, which can be found in Folder 9. The purpose for this is their argument that when charters were passed incorporating the C&O Canal Company, that a compact was formed between Virginia, Maryland, and the United States. The Complaint's response discusses this point as well, and is also found in Folder 9. The compact seems to be inferred in the response of the C&O Canal Company, which is in Folder 10. On page 2 of the response, the lawyers discuss how the navigation of the Potomac River becomes a concern following "the peace of 1783," and that such concern followed with the chartering of the Potomac Company, however, nothing is directly said about the Compact.

There was no known circuit court case number for this case, and MSA is not in possession of a docket from the Washington County Circuit Court for this time period. A COURT OF APPEALS (Docket) was consulted to obtain a term and case number, then the brief of the case was examined. The brief referred me to the Circuit Court Case. The citation for the case is as follows:

Searched BALTIMORE CITY CIRCUIT COURT (Equity Docket, Index) for any references to Joseph O'Neal and the Virginia and Maryland Bridge Co. This index is only a defendant index. Since O'Neal was the original defendant in the Washington County Circuit Court case, I searched for him, and found no references to Joseph O'Neal between 1853-1861. It appears that the reference in the recorded opinion of the Court of Appeals is incorrect. The index for BALTIMORE CITY CIRCUIT COURT  No. 2 was not examined, as it was not established until 1888.

There is no mention of a recording of this case in the COURT OF APPEALS (Judgement Record). There are also no COURT OF APPEALS (Transcripts) for this time period.

Researched correspondence related to 1853 Chapter 179, which granted rights to the President of the United States pertaining to water for the City of Washington. Located the following references in GOVERNOR (Letterbook) Volume 1845-1854 [MSA S1076-3, 2-26-2-31]:

On March 10, 1853, Jefferson Davis the US Sec. of War, wrote to Gov. Lowe stating that "At the last session of Congress an approriation was made for the purpose of bringing water into the City of Washington, and that if the plan adopted by the President should require water to be drawn from any source within the limits of Maryland, the assent of the Legislature of that state should first be obtained. And another act prohibits the expenditure of public money upon any land purchased by the United States until the consent of the Legislature of the State, in which the land may be, shall be given to said purchase. I have therefore the honor to request that the assent of the Legislature of Maryland, be given to the use of such water as may be found necessary in the execution of the work above provided for, and the purchase of such lands as may be required for that purpose. I enclose the draught of an act which would meet the views of this Department." (pp. 412-413)

Gov. Lowe replied to Sec. Davis on March 24, 1853, stating "I have this day transmitted to the General Assembly copies of your letter, and the accompanying draft of a law, which you say will meet the views of your Department." (p. 413)

Following passage by the General Assembly of Chapter 179, Gov. Lowe wrote to Sec. Davis on May 5, 1853, transmitting a copy of the act. (p. 430) Sec. Davis acknowledged receipt of this transmittal in a letter to Gov. Lowe on May 10, 1853 (p. 436)

I also searched MARYLAND INDEXES (Governors Records, Index), MSA S1274, which includes GOVERNOR (Miscellaneous Papers) for 1850-1868, but found no references.

Searched all boxes in GOVERNOR (Miscellaneous Papers) concerning letters and reports from 1876-1877 concering Isaac Jones and his report to the Governor concerning the boundary dispute with Virginia. No references were located.

Researched Acts of Maryland 1853 Chapter 179, An Act giving the assent of the State of Maryland, to such plan as may be adopted by the President of the United States, for supplying the City of Washington with Water passed May 3, 1853, and appears on pages 208-209 of the 1853 Laws of Maryland.

The bill was introduced in the Senate on March 30, 1853 by Mr. Williams from the Committe on Judical Proceedings. The bill was read and ordered to be printed. (p. 186) On April 5th, the bill was read a second time and ordered to lie on the table. The words "for the purchase" were inserted in teh 4th line of the 2nd section, after the word "or." (p. 204) On April 15th if was made the order of the day for next Wednesday. (p. 253) On April 20th, the bill was laid on the table. (p. 261) The bill was read for the third time on April 29th. The 5th section was striked out a new one added. The bill passed 12-0 and was sent to the House. (pp. 313-314) The bill was retruned passed by the House on May 5th. (pp. 331-332)

The first reading of the bill took place in the House on April 30th, and was referred to the Committee on Internal Improvements. (p. 654) The bill was read for the second time on May 2nd, and ordered to a third reading. (p. 659) The third reading occurred on Mary 3rd, at which time the bill was passed 41-1, and returned to the Senate. (pp. 673-674)
