Cases Handled By J. Steward Davis, 1924

Clarence Thomas v. John R. Brinkley
Davis & Evans for defendant, Hawkins & McMechen for plaintiff.  Suit filed June 3, 1924.  Plaintiff claimed that he loaned defendant $300 to help buy a car, with the agreement that he would pay the plaintiff back after the car had been fully paid off.  Debt was not repaid and plaintiff filed suit for repayment and for an injunction preventing defendant from selling the car.  Defendant ordered to pay $300 by Court, December 4, 1924.  Fi Fa filed on April 11, 1925 to recover all $300, which the defendant evidently did not pay; returned nulla bona (no goods to seize).

Ex Parte In the Matter of Maggie Blake, sometimes called Maggie Walton, an infant
Davis & Evans for Ultruss Walton.  Petition filed December 11, 1924 seeking custody of Maggie Walton/Blake. Maggie was an eight-year-old ward of the state of Virginia who had been placed in the custody of Ultruss and his wife Laura Walton.  Laura had moved to Baltimore, taking Maggie with her, and begun divorce proceedings against her husband, who she alleged did not support Laura or Maggie. Divorce proceedings allegedly stalled by Ultruss' refusal to pay counsel fee and alimony. The Virginia State Board of Public Welfare asked that the court remove Maggie from her mother's custody for violation of the original custody agreement, which stipulated that the child could not be moved out of Virginia, as well as possible neglect and adultery.  The court's final order, issued on August 30, 1927, sent Maggie back to the custody of the State Board of Public Welfare.
