Counsel's opinion requested as to pa./raont of bills, etc., of Unitod Hallways Company. Sewerage question on Liberty Rd, in Balto.Oo. adjoining Baltimore City. 15th, 1912. The Chcirnan presented to the Board plat showing the proooaed location of a crossing of the Spa Spring & Grette Railway Company at the intersection of the Bladensburg State Poad and the road from the District Line, for which application had not been made to the Commission. The Chief Sngineer recommended that the Commission refuse any further rights to the Spa Spring & Gretta Railway Company, and if necessary, get out an injunction to prevent further use of the State Road until said Railway Company has complied with the terras of an agreement between said Company and this Commission under date of July 12th, 1910. On motion of Dr. Heneen, seconded by Mr. Shoemaker, the Chief Engineer's recommendation v/as approved. Relative to the charges for lowering sewer of Dr. Theodore Cooke on the Harford Road, the Chairman read a letter from the Counsel advising that the permit granted Dr. Cooke be revoked and that the service be removed or plugged. On notion of Governor Goldsborough, seconded by Mr. Lloyd, the Chairman was requested to notify Dr. Cooko that unless his bill is paid within a week, the Board will issue instructions to have the sewer plugged. Dr. Hensen moved that the letter of Er. \7m. A. House, President of the United Railways & Electric Company, relative to the payment of its bills, settlement by arbitration of the questions involved in the deductions from time to time made on same, etc., be referred .to the Counsel, and that he be requested to give an opinion in this matter after consultation with Ilr. Isaac Lobe Straus and the Attorney General, said opinion to be in the possession of the Board at its next meeting on February 1st. The motion was seconded by i!r. Shoemaker, and adopted, lilr. Benson addressed the Board relative to the sewerage question on the Liberty Hoad in Baltimore County, adjoining Baltimore City, stating that as conditions at this point were so bad, and he could see no ground for actual damage at the present time, he would suggest that the Commission take care of the surface water by turning same into the private sewer of Mr. Callaway. Governor Goldsborough moved that the suggestions of the Counsel, as stated, be adopted. The motion was seconded by Dr. Hemeen, and carried.
