Damages in matter of Miles & Tighe vs. Montgomery County. Roads Commission or the City of Baltimore. Dr. Remsen moved that the substance of the Chief Bngineer's report be communicated to the proper City Authorities, asking their wish in the matter,and that Messrs. P. Flanigan & Sons be advised as to this action. The motion was seconded by Mr. Hutton, and adopted. Messrs. Fisher & Carozza, contractors on Contract #164 S.A.R. in Talbot and Caroline Counties, requested the Commission to use its efforts to have the County Commissioners of Caroline and Talbot Counties reimburse them for an amount of $207. which they paid for borrow excavation in Caroline County on Contract #164 S.A.P.. It was the sense of the Board that Messrs. Fisher & Carozza be informed that this matter is entirely between the Contractor and the Counties. On motion of Mr. Hutton, seconded by Mr. Lloyd, the final estimate on Contract #0201 (David B. Walsh, Contractor) was ordered paid, less a deduction of $63.00 to cover cost of supplying stone for the first course on this contract in accordance with specifications between stations 13 and 14420, and between stations 15 and 16+50, as recommended by the Chief Sngineer. Dr. Remsen moved that the work on Contract #0104 in Queen Anne's County, (Juniata Paving Company, contractors) be accepted, the final estimate paid, less a deduction of $670. to cover extra cost of inspection, and the bond released. The motion was seconded by Mr. Lloyd, and adopted. Mr. Benson, Counsel to the Commission, under date of October 26th, 1911, addressed the Board relative to Judgment of $600. confessed by Montgomery County in the matter of Miles & Tighe vs. Montgomery County - for extra work and damages claimed by reason of the fact that their plant was tied up during the winter on Contract #169 S.A.R., advising that $250. of this amount be paid by the State, as recommended by the Chief Engineer. On motion of Dr. Clark, seconded by Mr, Shoemaker, the Chairman was authorized to forward to the Comptroller a supplementary statement covering the amount of $250., and he was requested to notify the County Commissioners of Montgomery County as to the action of the Commission.
