The minute books of the Baltimore & Reisteretown Turnpike Company show several recorded and unrecorded agreements in reference to water mains, gas mains and drainage. The question of water mains, being with the Mayor and City Council, I do not consider important, as they would have to take care of this question. The Gas Company has acceded to our rights to have them move their mains upon request, and tho C. & ?. Telephone Company have also recognised our right to have them move their poles. There is an agreement with the Allied Realty Company and others for drainage, bearing date of September 11, 1907, which contains an express provision that tho Realty Company shall bear the expense of changing its pipes in case of a change of grade. There is one agreement bearing date October 14, 1888, with Jno. M. Matthews and others, unrecorded, to construct a drain pipe from the premises of the late Lewis Turner on the east side of the Road, a short distance north of florth Avenue, across the road to certain premises on the west side of said Road, nearly opposite thereto. There is no provision for changing or renewing the pipe in case of a change of grade. I do not consider this matter one of importance, as the location being near North Avenue, and the streets north thereof having been located, there is no probability of a ohange of grade at this point. The Chairman stated that he had received a communication from Mr. Clinton Uhl, Chairman of the Road Directors of Allegany Allegany County's ahare of County, wherein the Hoad Directors agreed to share equally with the liquidated damages on Borden- Commission the liquidated damages on Contract #194A (Bordonshaft-shaft-Midland Road. Midland Road), amounting to $600. On motion of Mr. Hutton, seconded by Mr. Shoemaker, the Chairman was authorized to sign a statement to the Comptroller for the payment of the State's share of this amount, ($300.)
