Dr. Hemsen moved, 'upon reoomnendation of the Chief , in order to facilitate the work on the Palls Road, Contract #0180, and secure its early completion, rind in view of the present condition of the vitrified brick market, that the recuent of V/nr -•-• Elder, contractor, that the variation test be Disregarded and that the requirement for the brick on the Baltimore County section of the Falls 3oad be that the average loss shall not exceed £2 in the rattler, be granted. On motion of I.'.r. Shoeritiker, eeconded by J)r» Rerisen, the adjiiRtnent of Contract #055 vrith T. J. Barrett, contractor , vrcfi referred to the Chair nan, nith. power. Mr. OPborne I. Yellott addressed the Board relative to the condition of the York ?ond from To\vson. tov/ard Bo.ltimore, stating that funds had been previously mis >d by citisens of Baltimore County to put In good condition the portion of the rond betvreen Cockev-svil le nnd To^pon, and t7ho v/ere nov/ willing to contribute half the cort of repairing the road from Towson., amounting to $3,000., provided the State Roads Commies ion would boar the remaining half of the expense. I.'.r. Tucker advised Mr. Yellott that the available funds for Baltimore County were exhausted and that, in hip opinion, there was no possible way of raising the State's portion for this work. Dr. Remsen offered the following resolution with regard thereto : H3SOLV3D that the Attorney General be requested to give the State 3oads Commission an interpretation of Section. 32Y, Chapter 116 of the Laws of Maryland (1910), that it may knov/ whether it has the authority to transfer from the Five Million Dollar Loan to the One Million Dollar Appropriation, Acts of 1910, the charges for that portion of the Annapolis
