Hunter Sykes, forner Chief-of-Party, regarding his salary for a part of the months of August and September 1909, amounting to $35.26. The Chief ^n^ineer made a statement to the Commission regarding Sykea, and 75r. ^emsen moved, in view of the Statement of the Chief "^ngi-neer, that the claim of a. Hunter Sykes "be not allowed. The motion vras seconded "by Jlr. Shoemaker, and adopted. The Secretary read a communication from I'essrs. McCormick & Company, Contractors, Philadelphia, Pa., in which they stated that they had arranged to secure $20,000 new capital to carry on the work under their contracts, provided the Commission will assure them that the monthly estimates hereafter to "be received would "be at least equal to the amount of the labor and freight bills during each nonth, otherwise they would "be forced into bankruptcy. T)r. Clark moved that a communication "be sent to McCormick & Company, as follows: "gentlemen: The State Heads Commission is in receipt of ..our communication of January 5th, and their action upon it is as follows: "The Commission regrets that you are unable to complete your contracts with the State of Maryland, as is clearly set forth in your communication. We cannot agree to modify these contracts as requested, and as you have notified us that unless we do so, you will have to go into bankruptcy, this forces us to treat your contracts '.;ith the State as abandoned by you. "Our Chief "^ngineer also reports to us that the work under your contracts did not progress satisfactorily and that in some cases it was not done according to specifications. "As stated above, in view of these facts, we are forced to treat your contracts as abandoned, and shall so notify the sureties on your several and respective bonds." Mr. Shoemaker seconded the motion, which was adopted. The Secretary was instructed to write the Rational Surety Company of >Tew York and the "^ipire State Surety Company of >T0w Yotffc the sureties on the bonds of McCormick & Company, enclosing a oopy of the letter this day forwarded to McCormick & Company, and to * advise them that attachments have been laid upon the estimate* work done by McCormick & Company,
