(295) That they have the whole matter in Variance between the Parties afs.d before the Court here &C.a And afterwards to wit the same Second Tuesday in March afs.d Comes as well the said Jeremiah as the said Moses by their attorneys afs.d as the said Richard Harrison & Walter Hanson the Referees afs.d who Return to the Court here the following award Viz.t Charles County ss.t We the subscribers being appointed by the afs.d County Court (with Consent of Parties) as Referees in an action now depending in said Court Jeremiah Aderton and Moses Drape do Certifie that after hearing the allegations and account son Both sides we find for the Plaintiff and Assess Damages to the sum of Eight Pounds one shilling and five Pence Virginia Currency and that the Defendant pay the Costs Given under our hands this Sixteenth March 1748 R.d Harrison Walter Hanson Whereupon the said Jeremiah Aderton by his attorney afs.d prays Judgment of and upon the Return of the Referrees afs.d in form afs.d found for him to be given It is therefore Considered by the Court here that the said Jeremiah do Recover against the said Moses his Damages afs.d to Eight Pounds one shilling and five Pence Virginia Currency of the Value of Twelve Pound Eighteen shillings and four Pence Maryland Currency so as afs.d by the Referrees afs.d awarded as also the sum of one Hundred and Sixty five Pounds of Tobacco for his Costs and Charges by him about his suit in this Part laid out and Expended by the Court here to the same Def.t in Mea Jeremiah of his assent by the Court here adjudged and the said Moses Drape in Mercy &Ca
It was Commanded the Coroners of Charles County that they should take Edward Jellings late of Charles County Planter if &C.a and him safe keep so that they should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the second Tuesday in March Next to answer unto Samuel Hanson Esq.r High Sheriff of Charles County of a plea of Trespass upon the Case &C.a and they should have then and there that Writ &C.a And now here at this day to wit the Second Tuesday in March afs.d Comes as well the said Sam.l Hanson b y Jeremiah Chase his attorney afs.d and offers himself against the said Edw.d Jellings in the Plea afs.d and Samuel Chunn one of the Coroners afs.d Returns to the Court here the Writ afs.d thus Indorsed Viz.t Cepi Corpus Sam: Chunn Coroner And now here at this day to wit the Second Tuesday in March afs.d Comes as well the s.d Sam.l Hanson by his attorney afs.d as the afs.d Samuel Chunn one of the Coroners of Charles County to which the afs.d Writ was directed and the said Edward Jellings altho Solemnly Called Comes not but makes default Thereupon it is adjudged by the Court here that the said Samuel Chunn one of the Coroners afs.d be annexed ^the Damages afs.d to^ the sum of Thirteen Hundred and Twenty one pounds of Tob.o (As) |
