(422) March Court Anno Domini 1747 Tuesday in March Next to Answer unto Clement Kennedy of a plea of Trespass upon n the Case and so forth and that he should have then and there that Writt &Ca At which day to wit the Second Tuesday in March afs.d Comes the said Clement by Jeremiah Chase his Attorney offers himself against the said William and the sheriff afs.d Namely Thomas Hungerford Gent Returns to the Court here that he has taken the body of the said William And the aforesaid William in his Proper person Comes and defends the force and Injury when &C.a and saith that he Cannot deny the action afs.d of him the said Clement nor but that he owes to the said Clement the sum of Eight Hundred and sixty one pounds of Tobacco as the said Clement above supposes Whereupon the said William by his Attorney aforesaid Prays Judgment and those Damages so acknowledged [illegible] with his Costs and Charges by him about his suit in this part laid out and Expended to him to be adjudged Therefore he Commanded by the Court here that the said Clement [illegible] against the said William his Damages aforesaid to Eight Hundred and sixty one [illegible] above acknowledged as also one Hundred and forty Pounds of Inspected Tobacco [illegible] and CHarges by him about his suit in this part laid out and [illegible] by the [illegible] adjudged & the said William in Mercy &Ca
Be it Remembered that Robert Haislip pursuant to the Directions of the act of assembly in those Cases late made and Provided lodged with the Clerk of the Court here the follwg Account and Warrant for attachment Viz.t
Robert Haislip mark Charles County ss.t Whereas it has been made appear to me that Lawrence Macnamara is Indebted unto Robert Haislip in the sum of Two Hundred and Twenty Six pounds of Tobacco as also that he is Runaway from the plea of [illegible] abode your therefore in his Lordships the Lord Proprietarys since Command to Issue presentment against the Effects of the said Lawrance Macnamara as well to him the said sum of Twelve Hundred and Twenty Six pounds of Tobacco as also the Incident [illegible] accrue thereon pursuant to the Directions of an act of assembly in such Cases made and Provided and for so doing this shall be your Warrant given under my hand the 9.th day of February Robt Hanson To the Cerk of Cha.s Co.ty Whereupon It was Commanded the Sheriff of the Goods Chattles and Credits of the aforesaid Lawrence Macnemara in his Bailywick being [illegible] atttach as well the sum of Twelve Hundred and Twenty six pounds of Tobacco Damages as six Hundred Pounds of Tobacco for Costs that had accrued and that further [illegible] accrue in Prosecution of the Premises and when the same he had attached or any Part thereof that he should have it before the Justices of the Lord Proprietary of his Next County Court to be held at Charles Town on the Second Tuesday in March Next then and there to be Condemned according to Law to and for the use of the said Robert unless the said Lawrance should Come then & there by himself or Lawfull Attorney and answer unto Robert of a plea of Trespass upon the Case (&) |
