(33) And the aforesaid John Marten in his proper person Comes and defends the force and Injury when &Ca and says that he Cannot deny the Action aforesaid of him the said John Muschett nor but that he owes to the said John Muschett the aforesaid sum of four pounds six shillings and six pence Currency in manner & form as he the said John Muschett above against him Complains Therefore it is Considered by the Court here that the said John Muschett do Recover against the said John Marten his Debt afs.d and his Damages ^by Occasion of Detaining that Debt^ to Two Hundred and Twenty four pounds of Tobacco to the same John Muschett on his Assent by the Court here Def.t in Mer Adjudged and the said John Marten in Mercy &Ca
