Court Anno Domini 1747
Charles County ss.t Peter Dent late of Charles County in the province of Maryland Planter otherwise Called Peter Dent of Charles County ^&^ abovesaid Planter was summoned to answer unto Samuel Hanson Jun of the same County & province aforesaid Gent of a plea that he Render unto him the Just & full sum of Two Thousand Six Hundred & Twenty Eight Pounds of ^Good^ Tobacco which to him he owes & unjustly detains & so forth And Whereupon the same Samuel by Jeremiah Chase his attorney saith that whereas the said Peter on the Twenty fourth day of February in the year of our Lord one Thousand Seven Hundred and forty Six at Charles County afs.d by his Certain Writing obligatory with the Seal of him the said Peter Sealed & he in Court produced whose date is the day and year afs.d acknowledged himself to be held & firmly bound unto the said Samuel In the Sum of Two Thousand Six Hundred & Twenty Eight Pounds of Good Tobacco as afs.d to the said Samuel when thereunto afterwards he should be requested Nevertheless the said Peter altho' often Requested the s.d sum of Two Thousand Six Hundred and Twenty Eight Pounds of Good Tobacco as afs.d or any part thereof to him the said Samuel to pay or in any sort to Content hath hither to altogether Refused and Stil doth Refuse to the Damage of him the s.d Sam.l Five Thousand Two Hundred and fifty six pounds of Tobacco as afs.d and therefore suit is brought & so forth John Doe & Rich.d Roe And the aforesaid Peter by Henry Darnall his attorney Comes & Defends the force an Injury when &C.a and prays a hearing of the Writing obligatory and it is Read unto him he also prays a hearing of the Condition of the same Writing and it is Read unto him in these words Viz.t The Condition of the above obligation is such that if the above bound Peter Dent do and shal well and truly pay or Cause to be paid unto the said Samuel Hanson Jun his Certain attorney Ex.rs Adm.rs or Assigns the just sum of One Thousand Three Hundred & fourteen pounds of Good Sound Merchantable Leaf Tobacco at or upon the first day of march Next Ensuing the date hereof with Legal Interest for the same then the above obligation to be Void Else to Remain in full force & Virtue Law but if default be made in the payment of the said sum of one Thousand Three Hundred & fourteen Pounds of Tobacco then I do hereby Impower my attorney in any Court of Record in the Realms of great Britain France or Ireland or within the province of Maryland or other his Majesties Dominions to appear for me at the Suit of the abovementioned Samuel Hanson Jun.r and to Receive a Declaration on the above obligation and thereupon to Confess Judgment by Nildicit Cognovit Actionem Nonsum Informatus or otherwise hereby Releasing all the errors that may happen upon ^the^ said Judgment suing out Execution thereupon or in any of the Proceedings thereunto Relating |
