(248) November Court Anno Domini 1747 Maryland ss.t Prince Georges County October 6.th 1747 Then Came Charles Rudd before the subscriber one of his Lordships Justices of the peace for the County aforesaid and made oath on the Holy Evangelist of Almighty God that the above account his Just and true and that he Never Received part nor parcel thereof nor any security or other satisfaction for the same Sworn before Jno Hawkins Junr Whereupon into Court herein his proper person comes Charles Baker of Charles County Planter and becomes pledge and security for the afs.d Richard that if it should appear that the afs.d Richard in the plea afs.d should be Convict that then the said Charles yeilded & Granted that as well the Debt afs.d as all Damages which to the same Chris.r & Com in this part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said Chrisr & Company If it should happen the said Charles the Debt and Damages aforesaid to the said Chris.r & Com should not pay or his body into the Custody of the sheriff by Reason thereof Render And the aforesaid Richard in his proper person Comes & defends the force & Injury when &C.a and says that he Cannot deny the action afs.d of him the said Chris.r & Company nor but that he did assume upon himself in manner & form as the said Chris.r & Company above against him have Complained nor also but that the s.d Chris.r & Company hath sustained Damages by means of not Performing the Promises & Assumptions afs.d to one thousand and forty eight pounds of Tob.o as the said Chris.r & Company above in Declaring supposes Whereupon the said Chris.r & Com by Henry Darnal their Attorney afs.d pay Judgment and those Damages so acknowledged together with his Costs and Charges by him about their suit in this part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said Chris.r & Company as Recover against the said Richard his Damages afs.d to one Thousand and forty Eight pounds of Tobacco above acknowledged as also the sum of Two Hundred and Seventy Eight pounds of Tobacco by him about their suit in this part laid out & Expended on his assent by the Court here Def.t in Mer adjudged and the said Richard in Mercy &Ca
