November Court Anno Domini 1747
1746/7 March 7.th I hereby Certifie that the above account is proved on the Acc.t Books of James Russell as the Law Directs Tho.s Brook Jun Whereupon into Court here in his Proper person Comes W.m Mcpherson Jun of Charles County Planter and becomes pledge and Security for the said Joseph that if it should happen the said Joseph in the plea afs.d should be Convict that then the said William Yeilded & Granted that as well the Damages afs.d as all Costs which to the said James & Company in this part should be adjudged of his Lands and Chattles should be made and levied to and for the use of the said James & Com that if it should happen that the said Joseph the Damages & Costs afs.d to the said James & Com should not pay or his body into the Custody of the Sheriff by Reason thereof Render And the aforesaid Joseph in his proper person comes and defends the force & injury when &C.a and says that he Cannot deny the Action afs.d of them the said James & Company nor but that he did assume upon himself in manner and form as the said James & Company against him hath Complained nor also but that the s.d James & Company hath sustained Damages by means of not performing the Promises and Assumptions aforesaid to one Thousand five Hundred and fifty Two Pounds of Tobacco as the said James & Company above in declaring supposes Whereupon the said James & Company by Jeremiah Chase their Attorney aforesaid prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this part laid out & Expended to them to be adjudged Therefore it is Considered by the Court here that the said James & Company do Recover against the said Joseph his Damages afs.d to one Thousand five Hundred and fifty Two pounds of Tobacco above acknowledged as also Three Hundred and Ninety Eight pounds of Tobacco for his Costs & Charges by him about his Suit in that part laid out and Expended on his assent by the Def.t in mea Court here adjudged and the said Joseph in Mercy &Ca
Be it Remembered that Samuel Hanson Jun pursuant to the Directives of the Act of Assembly in those Cases late made and provided lodged with the Clerk of the Court here the following Account and Warrant pr attachment Viz.t |
