(146) August Court Anno Domini 1747 Made and unperformed as also Three Hundred and Thirty Eight Pounds of Tob.o which to the same Joseph of his ^assent^ were adjudged for his Costs and Charges by him about his Suit in this Part laid out and Expend whereof the said Edward Thomas & John are Convict & that he should have then and there that Writt &Ca And now here at this day to wit the Second Tuesday in August aforesaid the sheriff aforesaid Returns to the Court here the Writt afs.d thus Indorsed Viz.t Cepi sat.d the she S Hanson She
It was commanded the sheriff that he should take Barton Hungerford late of Charles County Planter if &C.a and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Cha.s Town on the second Tuesday in August Next to satisfie unto John Goodwin Esq.r as well the sum of One Thousand five Hundred and Thirty Two Pounds of Tobacco which to the s.d John in the Court of the said Lord Proprietary before the Justices afs.d were adjudged for his Damages which he had by occasion of a Certain Promise and Assumption to the said John by the said Barton at Charles County afs.d made and unperformed as also Two Hundred and Thirteen Pounds of Tobacco which to the same John of his assent were adjudged for his Costs and Charges by him about his suit in this Part laid out and Expended whereof the said Barton is Convict and that he should have then & there that Writt &Ca And now here at this day to wit the Second Tuesday in August afs.d the she afs.d returns to the Court here the Writt afs.d thus Endorsed Viz.t Cepi superseeded S Hanson She and with the Writt afs.d he Returned to the Court here the following superseedas Viz.t Charles County ss.t You Barton Hungerford Sen of Charles County Planter and Barton Hungerford Jun and William Hungerford of the afs.d County do Confess Judgment to John Goodwin Esq.r of Liverpoole Merchant for the sum of seventeen hundred and forty two pounds of Tobacco which sum was Recovered by the said John Goodwin Esq.r against the said Barton Hungerford Sen by the said John Goodwin Esq.r in the said Court the said seventeen Hundred and forty five Pounds of Tobacco to be levied of your bodies Goods or Chattles Lands or Tenements for the use of the said John Goodwin Esq.r in Case the said Barton Hungerford Sen shall not pay and satisfie to the said sum of Seventeen hundred and forty five Pounds so as afs.d Recovered against him with the additional Costs thereon on the Tenth day of February Next Taken and acknowledged before us this Third Day of July Anno Domini 1747 William Middleton To the Clk of the said County Arthur Lee |
