(112) June Court Anno Domini 1747 Whereupon into Court here in his Proper Person Came Simon Smith of Charles County Ship Wright and became Pledge and Security for the afs.d John Mckie that if it should happen the afs.d John Mckie in the Plea afs.d should be Convict that then the said Simon Smith yielded and Granted that as well the Debt afs.d as all Damages which to the same John Hepburn in this Part should be adjudged of his Lands and Chattles should be made and Levied to and for the use of the s.d John Hepburn If it should happen the said John Mckie the Debt and Damages afs.d to the said John Hepburn should not Pay or his body In to the Custody of the sheriff by Reason thereof Render And the afs.d John Mckie in his Proper Person Comes and defends the force and Injury when &C.a and saith that he Cannot deny the Action aforesaid of him the said John Hepburn nor but that he owes to the afs.d John Hepburn the sum of one Thousand Pounds of Tobacco and no more Whereupon the same John Hepburn by his attorney afs.d Prays Judgment and those Damages so acknowledged with his Costs and Charges by him about his Suit in this Part laid out and Expended to him to be adjudged &Ca Therefore it is Considered that the said John Hepburn Recover against the said John Mckie his Damages afs.d to one Thousand Pounds of Tobacco above acknowledged and also Two Hundred Pounds of Tobacco for his Costs & Charges by him about his suit in this Part laid out and Expended on his assent by the Deft in mer Court here adjudged and the said John Mckie in Mercy &C.a
Be it Remembered that the Executors of Vincent Askins Pursuant to the Directions of the act of Assembly in those Cases late made and Provided lodged with the Clerk of the Court here the following account in a Warrant for Attachment Viz.t
