156 five pounds Eight Shillings and Six pence Sterling money of Great Brittain which to him he owes and unjustly detains &c And Whereupon the said Philip by Robert Jenckins Henry his Attorney says that whereas the af.d John the xxij day of march in the year of our Lord one thousand seven hundred and forty at Somerset County af.d by his Certain writing obligatory which the same Philip with the seal of the af.d John sealed here into Court brings the date whereof is the same day and year af.d did Acknowledge himself to be held and firmly bound unto the same Philip in the af.d sum of Ninety five pounds Eight Shillings and Six pence sterling to be paid to the same Philip when thereof he should be requested Nevertheless the af.d John altho often requested the said Ninety five pounds Eight Shillings and Six pence sterling unto the same Philip hath not as yet paid but the same to him hetherto to pay hath refused and still doth refuse to the damage of the same Philip one hundred pounds Sterling and thereupon he brings Suit &c Pleg.s &c J Doe & R Roe And the af.d John Fleming by George Douglas his Attorney Cometh and defendeth the force and Injury when &c and saith that he Cannot deny the Action af.d of the af.d Philip Lee nor Can he say but that the writing obligatory af.d is the deed of the same John nor Can he say but that he owes the same Philip the af.d Ninety five pounds Eight Shillings and Six pence Sterling in manner and form as the af.d Philip above against him hath declared Therefore it is Considered that the af.d Philip Lee recover against the af.d Peter Taylor his debt af.d & his damages by Occasion of the detention of the same debt to 275 pounds of tobacco to the same Philip of his Assent by the Court here adjudged and the af.d Peter in Mercy &c Memorandm the plf.t Releaseth out of the above debt fourteen pounds tenn shillings and Seven pence sterling &c
Pounds Currt money of Verginia of the Value of One hundred and twenty pounds Currt money of maryland which to him he owes and unjustly detains &.a And Whereupon the same Robert by William Arbuckle his attorney says that whereas the af.d Nathaniel the fifth day of March Anno Dom Seventeen hundred and forty One by his Certain writing Obligatory which the same Robert sealed with the seal of the af.d Nathaniel hereinto Court brings whose date is the day and year af.d acknowledged himself to be held and firmly bound to the same Robert in the af.d sum of eighty pounds to be paid to the same Robert when he should be thereto afterwards Required Nevertheless the af.d Nathaniel the af.d sum of eighty pounds Altho' by the same Robert often Required hath not paid but the same to pay hath Altogether Refused and still doth Refuse Whereupon the same Robert saith he is damnifyed |
