4 And afterwards this Same third Tuesday of March to witt the Fifteenth day of the Same month Anno Dom One thousand Seven hundred & thirty Six before the Justices of his Lordships County Court of Somerset now here held In the Court house at dividing Creek in and for the Same County Comes the said Mary Walker in her proper person and had a hearing of the Indictment afd and being Instantly demanded how she would acquitt her Selfe of the premisses afd above upon her Imposed says that she is Guilty thereof ^and makes oath that a Certain John Whitehead is the begetter of the Child she stands Indicted for^ but hath not wherewithall to pay her fine for the fact afd Whereupon all and Singular the premisses by the Court here seen heard & fully understood &c It is Considered that the afd Mary Walker be whipt at the publick whiping post with ten Stripes on the Bear back well Laid on untill the blood appear and that she be taken &c and thereupon as to the Corporall punishment afd Command is given to the sheriffe of Somerset County that he do thereof Immediate Execution by whiping of the afd Mary Walker at the publick whiping post with ten Stripes ^on the bear back^ well Laid on untill the blood appear &c and afterwards [illegible] the same Court Came the Said Cler and made return to the Same Court that he had done [illegible] the Judgm.t afd as to the Corporall punishment afd he was Commanded &c Whereupon the said Mary Walker is ordered to give Security for the payment of the Severall officers their fees due by means of the premisses afd on the Indictment afd &c Thereupon a Certain Abraham Smith present here in Court in his proper person undertook for the said Mary Walker and acknowledged himselfe Indebted unto his Lordship the Right honrble the Lord proprietary of the province of Maryland in the Sum of five hundred pounds of tobacco of his ^body^ goods and Chattles to be made & Levied to the use of the Severall Officers of Somerset County Court that hath a right to any Fee or Fees on the Indictment afd against the said Mary Walker In case the Said Mary Walker do not pay and Satisfie unto the afd officers their Fee or Fees due as afd &c Likewise the said Mary Walker is ordered to give Security for her appearance [illegible] & Every day of this term in order to give Evidence on behalfe of his Lordship [illegible] the said John Whitehead &c Thereupon the afd Abraham Smith present here [illegible] person acknowledged himselfe to be Indebted unto his said Lordship the Lord [illegible] Sum of ten pounds Curr.t money of his goods and Chattells Lands and tenements [illegible] Lordship the Lord proprietary his heirs and Successors ^to be made & levied^ if it happen that the said Mary [illegible] make her personal appearance here in Court from day to day and Every day [illegible] to give Such Evidence as she shall know on behalfe of his said Lordship [illegible] Whiteheade and do depart the Same Court without Leave &c according [illegible] her personall ^appearance^ from day to day and Every day of this term in order [illegible] this Court the said Abra: Smith is discharged from the [illegible] |
