152 as the aforesaid James above against him hath declared Therefore it is Considered that the aforesaid James Longo recover against the aforesaid John Farloe his debt afd and his damages by occasion of the detaining of the same debt to 255 pounds of tobacco to the same James of his assent by the Court here adjudged and the aforesaid John in Mercy &a
have his body before the Justices of his Lordships County Court of Somerset to be held at deviding Creek in the same County the third tuesday of November Anno Dom one thousand seven hundred and thirty seven to answer unto John Lewis of a plea of trespass upon the Case &.a And hereupon the said John Lewis by George Douglas his attorney declared against the af.d William Kitchen in form following viz.t Somerset ss.t William Kitchen late of Somerset County merchant was attached to answer unto John Lewis of a plea of trespass upon the Case &.a And whereupon the said John Lewis by George Douglas his attorney complains that whereas a Certain john Stone useing trade and Commerce as a merchant according to the Custom of Great Brittian and maryland on the twenty first day of July Anno Dom MDCCXXXV in maryland that is in Somerset County af.d within the Jurisdiction of this Court made and drew his certain first bill of exchange with his proper hand and name Subscribed and directed to a Certain Isaac Milner Merchant in London there useing Commerce as a merchant as by the said bill did request the said Isaac at twenty days after sight of the said bill his second or third of the same tener and date not being paid to pay unto the af.d W.m Kitchen or order the sum of twenty eight pounds eight shillings starling for value of him received which said first Bill of exchange afterwards to witt the same day and year af.d at the County af.d the said William Kitchen useing trade and Comerce as |
