124 but the same Charles altho' Solemnly Called to answer Cometh not nor the same attorney of the afd Charles and for the Same Charles saith nothing thereof in barr or preclusion of the action afd of his said Lordship by which the Same Lord Proprietary remaineth thereof against ^him^ undefended &c Therefore it is Considered that his said Lordship the Right Honourable the Lord propry of the province of Maryland recover against the afd Charles Dickerson the afd Ten pounds sterling 269 his debt afd as also Two hundred & Ninety three pounds of tobacco for his damages occasioned by detention of the same debt to his said Lordship by the Court here adjudged and that the afd Charles be taken &c Whereupon Came hereinto Court Cornelius Dickerson of somerset County planter in his proper person and undertook for the same Charles Dickerson and assumed upon himself (Likewise the same Charles Dickerson present herein Court in his proper person assumed upon himselfe) that if it Should Happen that Judgment in the plea afd should be rendered for the Same Lord Proprietary against him the same Charles or that ^he^ the said Charles should be therein Convicted that than he the said Charles should pay and Satisfie unto the said Lord Proprietary the Judgmt of the Court thereupon or render his body in Execution of Such Judgment to the prison of the Sheriffe of the County afd or that he the said Cornelius Dickerson will do the same for him &c
County Court of Somerset to be held at dividing Creek the third Tuesday of June anno Dom One thousand Seven hundred & thirty Seven to answer unto Robert Ritchie of a plea that he render unto him fourteen pounds sixteen Shillings and nine pence which to him he oweth and unjustly detaineth and that thereof he Should not fail &c Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the said Robert Ritchie by William Beckingham his attorney and the Sheriffe of the County afd to witt Joseph Macclester Gent at the Same day here returned that he had taken the aforesaid John Evans whose body here at this day he had ready to answer unto the afd Robert Ritchie of the afd plea as to him it was Commanded Whereupon the afd John Evans puts in his place George Douglas Gent attorney at Law against the afd Robert Ritchie of the afd plea Thereupon at the request of the parties afd day is given to the same parties before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of August then next following |
