Therefore he and his pledges of prosecuting be in mercy and Lett the plantiff name pledges &.a and that
the afd John Odear goe thereof without day also it is Considered that the afd John Odear Recover against
the said Moses Tilman his damages by occasion of the premisses to One hundred
100                 pounds of tobacco to the same John Odear by discretion of the Justices here at his request
for his Costs and Charges in that part Sustained according to the form of the Statute &.a by the Court here

     Command was given to the Sheriff of Somerset County that he Should take
Thomas Lambden late of Somrsett County Merchant al.s dict
Thomas Lambden of Sumersett County in the province of
Maryland Marchant if he should be found in his bailywick and
him should safe keep so that he might have his body before the Justices of his Lordships
County Court of Somerset to be held at dividing Creek y.e third Tuesday of June then next
to answer unto John Atkinson of a plea that he render unto him One hundred & Sixty
pounds curr.t Cash of Maryland which to him he owes and unjustly detains &.a

    And the aforesaid John Atkinson by Francis Allen his attorney declared against
the aforesaid Thomas Lambden in the plea aforesaid as Followeth Viz.t

Somerset County tt   Thomas Lambden late of Somrsett County Merchant al dict
Thomas Lambden of Sumersett County in the province of Maryland Marchant was
Sumoned to answer unto John Atkinson of a plea that he render unto him One hundred
and Sixty pounds curr.t Cash of Maryland which to him he owes and unjustly detains &.a

    And whereupon the s.d John by Francis Allen his attorney saith that whereas the s.d
Thomas the twenty Fifth day of August Anno Dm Seventeen hundred & thirty three
at the County of Somrsett afores.d within the Jur of this Court by his certain writing
obligatory which the s.d John with the seal of the s.d Thomas Signed hereinto Court
brings the date whereof is the same day & year af.d did acknowledge himself to be
bound unto the s.d John in y.e aforesaid One hundred & sixty pounds to be paid unto
y.e s.d John when he should be thereunto required yett the s.d John tho' often required
the s.d Eighty pounds to the s.d John hath not rendred but the same to him
hitherto to render hath deny'd and Still doth deny and unjustly detain to the damage
of the s.d John of tenn pounds money aforesaid and thereupon he brings Suite &.a
